Indonesia Forward With Omnibus Law

In addition to the issue of coronavirus disease 2019 (COVID-19), currently the public sphere is being enlivened by the controversy over the Draft Omnibus Law on Employment Copyright that was drafted by the Governments of President Jokowi and Ma’ruf Amin. Apart from the substantial discourse, the Draft Omnibus Law on Employment Copyright is considered in addition to having weaknesses such as the impression of executive dominance and tends to change the practice of forming legislation, also has a number of specific advantages, among which can be a solution for conflict resolution between legislative regulations or clashes between regulations, in addition to solutions to regulatory inconsistencies.

The party that is pro against the omnibus law is of the view that in the midst of global economic competition, the government must accelerate the economic development process so that it can become the top five powers of the world economy by 2045. One of the government’s efforts is to create investment-friendly regulations and can accelerate the pace of the development process. However, real conditions on the ground are often hampered by regulatory problems that are seen as hampering investment.

On this basis the government wants to cut this pathway through deregulation and debureaucracy policies. Concretely, the government wants to carry out legal reform through the omnibus law bill in order to facilitate and form an investment-friendly climate for investors for the welfare of the people. However, of course the government’s steps are not as smooth as imagined, although the goal of establishing this omnibus law is very good for the welfare of Indonesia. In fact, this action triggered a negative response from certain parties which were expressed several times during demonstrations. However, it should be noted that there are many ways to criticize this law, one of which is to make an internal study where the results can be sent to the government as an evaluation material so that this omnibus law can be better. The formation of a law will not necessarily make all parties satisfied, there must be a number of parties who feel disadvantaged by the existence of these rules. This also happened to Omnibus Law. Opinions about the omnibus law bring profit or loss can be proven later when the government has ratified the policy.
