The government continues to investigate mass gathering and incitement by Rizieq Shihab during the Covid-19 pandemic. The action is considered proportional and in accordance with the applicable law. The child marriage of the leader of the Islamic Defenders Front (FPI) Rizieq Shihab has resulted in a criminal offense. The police decided to detain Habib Rizieq on December 13. This detention also made his group furious. Rizieq immediately submitted a pretrial to test the suspect’s determination and detention at the South Jakarta District Court. Meanwhile, the Polda Metro Jaya legal team as defendant I in the pretrial lawsuit filed by Habib Rizieq Shihab emphasized that the investigation and determination of the suspect against the FPI leader of the mass organization was legitimate. Investigators carry out the law enforcement process according to applicable regulations. Head of the Legal Division of Polda Metro Jaya Kombes Pol Hengky said that his party was in accordance with the rules which were implemented in a professional, transparent and accountable manner. At the hearing of the respondent’s response to the material of Habib Rizieq’s claim as a petitioner, it was revealed that the Polda Metro Jaya as defendant I had examined Rizieq as a witness and then as a suspect. The police have also asked for statements from witnesses as well as experts and case titles. From all these stages investigators recommended Habib Rizieq as a suspect in Article 160 of the Criminal Code and Article 93 of Law Number 6 of 2018 concerning Health Quarantine and / or Article 216 of the Criminal Code. Polda Metro Jaya has also sent a decision letter as a suspect to the DKI Jakarta High Court, the reporter and also the petitioner. The Polda Metro legal team also stated that on December 12, 2020, Respondent 1 had arrested the applicant, completing an arrest warrant and an arrest warrant. However, the applicant refused to sign a receipt for the arrest warrant, and a receipt for the arrest warrant. Furthermore, Respondent I or Polda Metro Jaya investigators also published an official report rejecting the signing of an arrest warrant and an arrest warrant. He also argued that the police’s decision to establish Rizieq as a suspect in the crowd case in Petamburan and Tebet, Jakarta, was normal. The determination of the suspect and the arrest warrant is certainly not sudden, but through a proper criminal justice system process. Meanwhile, The Center for Indonesian Crisis Strategic Resolution (CICSR) fully supports law enforcement against Rizieq Shihab. Muhammad Makmun Rasyid as Director of CICSR expressed his support, responding to the shooting incident at the Jakarta-Cikampek Toll Road which resulted in the death of six of Rizieq Shihab’s followers. It also believes that state security institutions will act in accordance with standard operating procedures and laws in force in Indonesia. Rizieq Shihab as a public figure certainly has to be an example for his followers, the legal process for him must continue according to the constitution.
