The government has taken the initiative to encourage the birth of the Omnibus Law on Employment Copyright ( Ciptaker ). The draft is a clear commitment of the Government to facilitate investments that are able to create new jobs.
Literally, the Omnibus Law (OBL) will be the largest source of law that covers other laws in Indonesia . This omnibus law will replace, revise or repeal other laws that have expired or are unable to take on a number of existing problems.
The aim of the Omnibus Law on Employment, as directed by President Jokowi, is to accelerate economic growth. The function itself is to simplify the rules that hinder the process of economic acceleration. The president wants more economic acceleration than at present. This policy, especially aimed at creating broad employment opportunities, and of course improving worker welfare.
Through the Omnibus law bill, all sorts of bureaucratic and regulatory complications can be tidied up. If one sector can rise up with this bill, it will be able to boost other sectors. The same is true with the Omnibus Law Ciptaker Bill . This bill has the aim to provide business licensing and an increasingly conducive business climate , including micro, small and medium businesses.
In a limited discussion held by the Independent Social Media Activists Forum (FPMSI) in Tebet Jakarta, citizens and various other groups invited the public to understand the importance of this Omnibus law bill. In addition, the Constitutional Law Expert at the Faculty of Law at the Muslim University of Makassar in Indonesia, Fahri Bachmid , assessed the existence of the Omnibus Law Ciptaker as an answer to the labor problems faced by Indonesia. For this reason, he supports the government in the era of issuing the regulation and emphasizes that the urgency of the Omnibus Law on Employment is that there is a dynamic of global change, a fast and appropriate response is needed, and without reforming policy reforms , economic growth will slow .
Because the bill is a response to the various problems, one of which overlap tindihnya legislation that often so inhibiting investment climate in Indonesia as well as answer productive age demographic bonus.
The moderator of the discussion as well as the National Coordinator of FPMSI Hafyz Marshal stated, the Omnibus Law Copyright Work Draft was made because licensing in Indonesia is very complicated and convoluted, even though economic transformation is needed in order to increase competitiveness and increase economic growth towards the welfare of the nation. “The work copyright bill is designed to facilitate all regulatory and licensing systems and investments that are expected to increase to increase employment and the quality of the workforce and welfare,” said Hafyz in a limited discussion.
According to Dhini Shanti Purwono, Stafisus of the President for Legal Affairs in a statement quoting Setkab , said that if there were narratives related to pro-entrepreneurs for large investors, this would not be true. In fact, the implication is that it makes it easy to do business for all investors, large, small, medium and micro.
Early to assess if the Omnibus Law is a law (Act) with the ability clicking -cover number of issues. So that later there will be no regulatory vacuum. Dini added that this ommibus law has heterogeneous contents. So it is not like other general laws. The Ciptaker Bill will emphasize infrastructure development in the first period.
Whereas for the second period the emphasis is on increasing human resources that are related to economic growth. This bill was specifically made targeting two major issues. Namely, unemployment and employment.
The big agenda of the President in this second period, is aimed at encouraging economic growth which means that it will be able to boost investment, investments that come both from outside and within the country. Therefore, investment will trigger employment growth. If there is no investment, surely there will be no new jobs, until economic growth decreases.
He also explained that his party also asked all regents or mayors to deposit targets to the Investment Office of the One Door Integrated Service (DPMPTSP) regarding the granting of business licenses to these small businesses. President Jokowi has even targeted around 10,000 small businesses this year to have free business licenses.
He also wanted DPMPTSP throughout Indonesia to be able to proactively move to the field to give the permit to small business owners. The reason is that licensing can easily affect the business owner’s capital access.
As explained above, omnibus law does not only provide benefits in one sector. but continuous. So that the percentage in an effort to realize an advanced Indonesia is greater. Not only opening employment, but also able to absorb the maximum workforce and reduce unemployment significantly. More than that, the economy as a state drive system will be able to accelerate to equalize the welfare of the people of Indonesia.
