The Omnibus Law Cipta Karya is one of the Government’s efforts to simplify obesity regulation. In addition to trying to facilitate investment, Omnibus Law is believed to have many positive impacts including absorbing labor.
Currently, Indonesia has entered the industrial era 4.0 where in that era speed is needed in every existing process, even to pay for it, now someone can pay for food without the need to take a wallet, simply scan the QR Code then the transaction is complete.
This is enough to illustrate that the process of economic transactions has undergone a revolution to be faster,
To welcome this, of course we have to adjust to the existence of a revolution of laws that cut the convoluted bureaucracy.
The 2003 labor law is outdated and out of date with current developments. So a new formula is needed, in which the government has prepared the formulation in the form of streamlining regulations in the Omnibus Law Bill.
Omnibus Law acts as a regulation to accelerate business licensing so that it can have an impact on the recruitment of new workers, this will certainly improve the national economy.
Political Communication Expert Iman Soleh said that the draft Omnibus Law aims to improve the investment climate and welfare of workers. Especially about the wage system that is often considered controversial is expected to be a clear regulation in this bill.
The Omnibus Law will provide certainty and guarantee for developing businesses for entrepreneurs, while for workers, the remuneration system changes from the daily system to working hours.
In addition, another positive side that workers can get from the omnibus law is the wider prospects for employment. Where new foreign capital companies will emerge and of course will require local labor.
Although the President has decided to postpone the discussion of the Omnibus Law Bill, of course this has become a momentum for stakeholders, trade unions and trade unions to deepen the substance of the Bill of Cipta Karya.
The drafting of the Cipta Karya Bill indeed needs public supervision. So in the discussion, it must involve all parties involved.
However, there should not be counterproductive reactions to the government’s good intentions. Because in essence the work copyright omnibus aims to simplify and improve labor governance in Indonesia.
The Ministry of Labor said, the minimum wage would not be eliminated. It should also be noted that the hourly wages that the government discourse is wages for workers in certain sectors.
In addition, sentiments about the entry of foreign workers are also often used as an excuse to reject the work copyright omnibus. Though Omnibus law does not necessarily make foreign workers (TKA) can enter easily.
Foreign Workers can enter if the skills or abilities needed are not owned by domestic workers. That was not for a long time.
Omnibus Law Cipta Karya is very possible to provide convenience to entrepreneurs, moreover the regulation also has a focus on simplifying domestic investment rules. Of course this is expected to be a catalyst for entrepreneurs around the world to invest in Indonesia later.
So far, there are many foreign investors who consider that the business climate in Indonesia is less favorable because it is very bureaucratic. Both in terms of licensing and business operations.
Researchers from the Center for Indonesian Policy Studies (CIPS) Felippa Ann Amanta said the Draft Omnibus labor law would open investment opportunities in the agricultural sector and could have a positive impact on farmers. Felippa explained that in accordance with the purpose of the Work Copyright Bill, it would cross out the regulations that had been assessed as inflating investment.
According to the Asian Development Bank, agricultural investment in Indonesia still mostly comes from the farmers’ own group, while the value of private investment is still very low. Total foreign investment is only 0.01 percent of total private investment disbursed for agriculture.
Of course we hope that with the postponement of the work omnibus copyright discussion, the government and other stakeholders can continue to work together to form a good investment climate.
Labor-related regulations do require adjustments to the times, sooner or later the Employment Copyright Bill is properly discussed and becomes a legal umbrella for investment ease and ease of finding employment.
