Menkumham’s Decision Revocation

Jakarta, CIDISS – Towards the end of 2015, the Minister of Justice and Human Rights (Menkumham) Yasona Laoly revoked a Decree (SK) related to an attestation of the Golkar management as a result of National Congress (NC) in Ancol, North Jakarta. The Ancol NC chose Agung Laksono as the general chairman of Golkar. Although revoked the decree, Yasona Laoly also did not endorse the Golkar management resulted by Bali NC in 2014 who chose Bakrie as chairman of the Golkar Party.

Menkumham’s decision was taken in an effort to give independence to the Golkar which is undergoing internal conflict. Thus, two camps, Aburizal Bakrie CAMPS and Agung Laksono camp, which are fighting over the Golkar internal management’s may seek a way out internally.

Besides having immediately to conduct an internal reconciliation, the Golkar party administrators will have to immediately form a new management to substitute post-repeal Decree management, namely the management resulted by Pekanbaru NC in 2009 which expired on last December 31, 2015. In other words, the Golkar Party is currently experiencing vacancy management, and they are not officially recognized by the government as a national party because there is no an authorizing officers Decree.

Similar conditions seem to be experienced by the United Development Party (PPP). Currently, PPP is also undergoing dualism management, namely the management resulted by Surabaya congress who chose Muhammad Romahurmuziy as chairman and the management resulted by Jakarta congress who chose Djan Fariz as chairman.

Previously, Menkumham has passed a stronghold Djan Fariz as a legitimate administrator of PPP. However, later, Menkumham will revoke the decision. As the result, the PPP must also reconcile to unite internally.

Not all parties approve the Menkumham’s decision, it happens because there are camps that promote more private interests without thinking about the interests of the party. In fact, some people measured the Menkumham’s decision as the government attempts to destabilize the party internal condition.

The emergence of these opinions can be considered reasonable because the conflict is an internally party matter. So, the government should not intervene. But, government’s action is not to intervene, but rather an attitude to provide the opportunity for the parties to focus in solving their internal problems. In addition, this condition also indicates that the political elite in Indonesia was not yet mature enough in politics.

Therefore, revoking the party stewardship validation decree is a right step to mature those political elites. In addition, repeal this decree would also eliminate the assumption that the government interfered in the internal affairs of the party. So, sooner or later, Golkar and PPP should be able to resolve its internal problems. Because, there is a greater interest should be given priority in addition to seeking personal gain. [DA]
