The Government and Parliament continue to accelerate the realization of the Omnibus Law Cipta Karya. The regulation is believed to be able to stimulate investment in Indonesia and provide welfare guarantees for workers.
Omnibus Law can be called as one of the solutions that would be offered by Indonesian President Joko Widodo, moreover the public already knows that Indonesia did not get any contribution from the trade war that occurred between the United States and China.
Certainly not dismiss if various regulations related to employment are often used as an excuse for business actors and regulators of investment stagnation in Indonesia.
On a previous occasion, the Coordinating Minister for the Economy Airlangga Hartanto had said, in the discussion on employment creation, a new scheme was being prepared in the field of employment relating to unemployment benefits. Where it is a facility for those affected by termination of employment.
Airlangga said the government had also prepared facilities such as job loss guarantees and this had been included in the BPJS Employment facility. That means for those affected by layoffs due to the closure of the company then the Social Security will immediately make cash benefits.
Meanwhile, the government also continues to work on completing the academic manuscripts and the draft of the Employment Copyright Bill in the near future. The plan is that as of January 24, 2020 the Omnibus law Cipta Karya is targeting 81 Laws.
But Airlangan said that the Employment Creation Bill in the Omnibus Law would be sent to Parliament later this week. Submission of the draft bill backwards from last week’s plan.
He hopes that the bill can absorb 7 million Indonesian citizens (Indonesian citizens) who are currently still looking for work.
The Coordinating Minister for Maritime Affairs and Investment Luhut Binsar Pandjaitan claimed that the omnibus law created by employment would benefit workers. This in between these rules will regulate a number of incentives for workers.
Luhut expressed optimism that the regulation could also create 3 million jobs each year. Thus, the number of unemployed in the country can be reduced.
According to him, the Draft Omnibus Law on Employment Copyright has now been signed by all parties. Luhut also stated that there were no more obstacles.
On different occasions, the Minister of Cooperatives and Small and Medium Enterprises (Menkop UKM) Teten Masduki ensured that the Draft Omnibus Law Copyright Employment will facilitate the growth and development of Micro and Small and Medium Enterprises (MSMEs), especially in terms of wages.
Teten said, the omnibus law would have a positive impact on SMEs. The first is the matter of wage policy because in this rule the wage policy for MSMEs is excluded from the minimum wage and others, meaning that later MSMEs can be more competitive compared to large businesses.
In fact, the policy is felt to be able to encourage partnerships or large businesses by doing subcontracting with cooperatives or MSMEs. This subcontracting means that large companies share their production with other MSMEs.
Surely the opportunity must be captured by MSMEs to further increase their production capacity.
He said, with the enactment of the employment copyright omnibus, it was hoped that industries that were previously active were moving from one region to another because they were looking for cheaper labor costs, which would no longer be the case because they preferred to partner with MSMEs.
Meanwhile, the possibility of MSME wages being sub-standard due to the exception, according to him, depends on the agreement between the worker and the business owner.
Previously, rumors had circulated related to the existence of omnibus law which would later eliminate the obligation of halal certification. This became the spotlight of the Chair of the PKS Faction in the House of Representatives Jazuli Juwaini who said that his party would be in the forefront to reject the draft bill proposed by the government.
In fact, there is no abolition of halal certification, but what is available is making it easier to administer halal certification.
The Ministry of Religion (Kemenag) straightens out the issue of eliminating the obligation of halal certification for products circulating in Indonesia in the Omnibus Law on Employment Copyright.
The positive impact, Omnibus law will also not be a cost burden for SMEs who will apply for halal certification. The government has agreed to free certification of halal product guarantees so as not to burden micro and small scale businesses.
Therefore, do not be provoked by things that are not true related to the omnibus law. The positive impact of the Cipa Omnibus Law on Employment is certainly the hope of the government.
