Allegations that the Government is hiding data on Covid-19 victims still occur, mainly through social media . In fact, the state has been transparent in disclosing data on Covid-19 victims to the public so that the public can be more alert to the potential for the transmission of the outbreak.
Information about Covid-19 continues to flow like a tsunami which often confuses people. However, often the information that is circulating actually contains misinformation ( hoaks ) that can trigger unrest in the community, is no exception to the notion that the Government is hiding the real data of Covid-19 victims .
In fact, it was reported that a doctor who was incorporated in the Indonesian Doctors Association (IDI) twisted his idea to leave all information regarding patient data that had been infected with Corona. The doctor who had submitted the proposal said that this was to assist the task or performance of the COVID-19 Task Force.
The reason, this is considered more effective to launch a number of traces in the form of contact tracing, where, when to who might have made contact with sufferers. The hope is to reduce transmission rates as well as the spread of disease. This transparency includes the name as well as the patient’s residence.
However, unfortunately this idea is contrary to Law 14/2008 regarding Public Information Openness (KIP) which emphasizes exceptions to patient data (refer to article 17h, article 18 and 54 of the KIP Law). Except if the owner has given written permission and violations of the use of public information including patients will be threatened with criminal sanctions.
Therefore, this idea then raises the option to be opened in a Minimalist way. So it cannot be fully opened to the public. However, it was sufficiently limited to convey to the COVID-19 Task Force, specifically as material for carrying out the task.
It can be concluded if the UU KIP definitely wants the protection of information related to patient data. However, it also does not mean having to open it by force into the public domain.
As an example of its application, the Task Force presents data transparency which includes the number of positive patients, death victims by province. In this case the information remains closed, especially the name as well as the patient’s home address.
This is also applied at the provincial government level which accurately presents data to the public domain with applications such as corona.jakarta.go.id. On this page the public can access the number of cases that are awaiting results, positive cases, which are treated, cured, died until independent isolation. However, for mapping, it remains a point in the village, district and not in detail such as a home address.
The provisions of hiding this data are not only explicitly regulated in the FOI Law, but also crucial enough to protect patients from discrimination, persecution, intimidation, and even terror that may be received by patients. because, It is very possible, if the patient ‘suspect’ COVID-19 is treated unpleasantly by certain communities in the area he lives.
However, specifically for the disclosure of patient personal data in order to carry out the task, it still needs extra attention in maintaining confidential and disciplined undergoing technical instructions (ju knis) regarding anyone who is entitled to receive data, observe, make decisions, and coordinate the field. Therefore, those who are given this information must take responsibility and carry out their duties optimally based on the objective of opening the information.
If this is the case, of course anti-transparency allegations posted can be broken. other possibilities are the responsibility to protect the patient’s personal matters. Naturally, if it is indeed critical in Indonesia related to the data presented. If there is only one news coming down for example, the patient is positive for COVID-19. Then his data will be up-and-running. If only for the information itself, no problem. If later on the share to the realm of the public with a larger scale such as social networking, wah can be dangerous! Bullying will be intensified, as if they don’t know the rules.
