Jakarta – The People’s Representative Council of the Republic of Indonesia (DPR RI) has approved the discussion of the Job Creation Perppu so that it can be ratified as a Law (UU), which in fact can also provide many benefits for the Indonesian people themselves, one of which is the expansion jobs.
In anticipating developments in the dynamics of the global economy which can indeed have a significant impact on the national economy, the Government of the Republic of Indonesia (RI) stipulates Government Regulation in Lieu of Law (Perppu) Number 2 of 2022 concerning Job Creation (Ciptaker) as an anticipatory policy in strengthening of domestic economic fundamentals.
The stipulation of the Job Creation Perpu is a constitutional implementation of the President’s attributive powers based on Article 22 of the 1945 Constitution. However, the exercise of this authority is also limited where the Perpu must be submitted to the DPR RI for approval. Thus the subjectivity of the President in enacting a Perppu will be assessed objectively by the DPR RI to be enacted into a Law (UU).
In this regard, at the Government Working Meeting (Raker) together with the Legislative Body of the People’s Representative Council of the Republic of Indonesia (DPR RI) in the context of Making a Level I Discussion Decision on the Draft Bill on the Determination of the Job Creation Perppu to become Law, on Wednesday, February 15 2023, a decision has been made that in fact the Perppu on Job Creation has been approved to be brought to the DPR RI Plenary Session.
The results of the decision are indeed in order to be able to make level II decisions and be passed into law. Furthermore, the Coordinating Minister (Menko) for Politics, Law and Security (Menko Polhukam), Minister of Law and Human Rights (Menkumham), Deputy Minister of Religion, as well as representatives from the DPR RI faction who were present at the Working Meeting, signed the the approval of the DPR RP Legislative Body for the Bill on the Stipulation of the Perppu on Job Creation to become Law.
The Coordinating Minister for the Economy, Airlangga Hartarto stated that indeed the Government of Indonesia itself had heard the views of the factions and gave appreciation, not only did they receive appreciation, but many of them also supported and approved it. Of course, all of this will also serve as input and record for the Government in implementing the Law on the Determination of the Perppu on Job Creation to become a Law later.
Furthermore, the Coordinating Minister for Airlangga also stated that the Job Creation Perppu provides legal certainty and benefits received by the community, MSMEs, business actors and workers for the implementation of the Job Creation Law, so that these benefits can be continued.
In connection with efforts to implement the Constitutional Court (MK) Ruling on the Job Creation Law, the Government together with the DPR RI have implemented the decision, namely the Omnibus method has been regulated in the preparation of the Law, then further improvements have also been made to technical writing errors contained in the Copyright Law Work and Government have also increased a lot of meaningful public participation.
For information, since the Job Creation Law (Ciptaker Law) came into effect, the Ministries/Institutions have conducted a lot of socialization and public consultations up to 610 times and also 29 times by the Job Creation Socialization Task Force. According to the Coordinating Minister for Airlangga, this shows that the government is continuing to carry out outreach, education, consultation, technical guidance, and even assistance that is really needed in the implementation of the Ciptaker Law.
Indeed, in the face of imagining various kinds of risks due to global uncertainty and the existence of national economic conditions, the Government of Indonesia continues to strive to be able to prepare many strategic steps through a responsive mix of fiscal and monetary policies.
It is also undeniable that indeed one of the strategic policies to be able to deal with global economic uncertainty is through the establishment of Regulation in Lieu of Law (Perppu) Number 2 of 2022 concerning Job Creation which aims to be able to encourage household consumption, domestic investment and also expansion of employment.
On the other hand, Professor of Gadjah Mada University (UGM), Prof. Nurhasan Ismail stated that with this compelling crisis, it is indeed very important to stipulate the Job Creation Perppu. This also needs to be interpreted as an anticipatory attitude towards economic conditions and is also able to provide the legal certainty needed to create jobs, especially from the Micro, Small and Medium Enterprises (MSMEs) sector. With the large number of human resources (HR) of the Indonesian people, especially those of productive age who are not small, it is indeed very necessary to expand employment opportunities. Therefore, the DPR RI then agreed to the Job Creation Perppu which was indeed very beneficial for the Indonesian people.
