The Omnibus Law on Cipta Kerja was designed by the government, not only for workers but also for MSME entrepreneurs. They are prioritized because 90% of business actors in Indonesia are MSMEs. There are several articles that are in their favor, and make business licensing easier and faster.
Currently, UMKM entrepreneurs are being tested because people’s purchasing power has decreased somewhat. They are trying hard to maintain their business even though we are still in the Covid-19 pandemic. It is true that opening a business is easy but maintaining it is difficult. MSME entrepreneurs try to innovate so that their business continues to produce.
To help UMKM entrepreneurs, the government designed a draft of the Omnibus Law on Job Creation. This law has several clusters that benefit them, including investment and ease of doing business. There will be changes in regulations regarding licensing, investment and labor. MSME entrepreneurs will run their business more lightly.
One part of the Omnibus Law that benefits MSMEs is article 99. MSMEs business permits are given intensively in the form of relief or even without fees. Small entrepreneurs who want to legalize their business can be enthusiastic because they are no longer afraid of high costs. The government understands that they still have small capital so that licensing fees can also be waived.
By having official permits, MSMEs can be recorded in the database of the Ministry of Cooperatives and SMEs. The benefit is that if there is assistance, it will be given directly to each account. In addition, if you are going to borrow additional capital from the Bank, the process will be made easier, because the MSME business is considered valid and has a clear business identity.
There is also Article 103 in the Omnibus Law of Work Cpta which states ‘the government facilitates the provision of legal assistance and assistance services for micro and small businesses’. Legal assistance is very important because there are still UMKM actors who are unfamiliar with this. For example, when they stumble upon a product copyright case, the government immediately helps them.
Meanwhile, Article 102 contains’ the government allocates the use of the Special Allocation Fund to finance empowerment and development activities of MSMEs. This rule is good because there are MSME businessmen who have been selling for a long time but don’t know their marketing and managerial strategies. So, the government will provide assistance through free seminars.
These seminars are usually held by the Cooperatives and UKM Office. In the mentoring program, they were taught not only how to make products to sell, but also to polish them to make them valuable. For example, the packaging is made exclusive, leak-proof, and provided with a label sticker complete with the writing of the HP contact. So prospective buyers will immediately call that number.
Minister of Cooperatives and SMEs Teten Masduki stated that the omnibus law of work copyright will make it easier for MSMEs to develop, because there is a cluster of ease of doing business. Also makes them progress because there are investments that are more encouraged to enter Indonesia. UMKM entrepreneurs may also ask for wage relief from their workers.
The investment cluster is indeed an important point in the work copyright omnibus law because investors are allowed to invest with looser permits. They can expand their UMKM businesses by injecting fresh funds, and share the proceeds. Moreover, investors are also encouraged to transfer knowledge. UMKM entrepreneurs are becoming more intelligent and shrewd in doing business.
If MSMEs continue to be assisted by the government, they can survive and expand their business. Indonesia’s financial condition will improve because there are no more businessmen who lose money, and they instead increase their purchasing power. We can survive the threat of a financial crisis or recession.
