Omnibus Law Working Copyright has Perspective of Equal Social Welfere

Omnibus Law should not be misunderstood to make mass actions, we must know that Omninbus Law Cipta Karya has the perspective of equal social welfare alias social welfare equality. This Omnibus Law means “for everything” related to a regulation product.

The aim of the government to make a legal revolution about the work copyright must be interpreted as an effort to improve the economy and create massive investment growth.

Previously, the Cipta Karya Bill was a priority proposal from the Joko Widodo administration in the second period. Through this omnibus law, Jokowi wants to cut and simplify regulations to attract foreign investment.

In the omnibus law, the government intends to harmonize 1,244 articles from 79 laws into the bill that was originally called Cipta Karya Kerja. So there is no overlapping of regulations that seem complicated.

Meanwhile, the Minister of Agrarian Affairs and Spatial Planning / National Land Agency (ATR / BPN) Sofyan A Djalil said that in line with the government, the ATR / BPN Ministry was participating in drafting the Omnibus Law on Employment Copyright.

He revealed that with the Omnibus of Employment Law, the world economy will be brighter, besides the unemployment rate will also be reduced, because investment from investors will give birth to new jobs.

Researchers from the Center for Indonesian Policy Studies (CIPS) Felippa Ann Amanta assessed that the Draft Omnibus work law would open investment opportunities in the agricultural sector and could have a positive impact on farmers. Felippa explained that in accordance with the objectives of the Work Copyright Bill, removing the regulations that had been considered to be an investment inflows.

According to the Asian Development Bank, agricultural investment in Indonesia still mostly comes from the farmers’ own group, while the value of private investment is still very low. Total foreign investment is only 0.01 percent of total private investment disbursed for agriculture.

According to him, the regulations that have been in force are considered unfriendly towards investment in the agricultural sector, one of which is in the horticulture sub-sector.

Law Number 13 Year 2010 concerning Horticulture in Article 33 is considered to limit the use of horticultural facilities from abroad and requires the obligation to prioritize facilities containing components of domestic production.

Article 100 of the same law also limits foreign investment to large horticultural businesses with a maximum capital of 30 percent. Foreign investors are also required to place funds in domestic banks as much as their capital holdings.

The requirements in these regulations certainly make investors think twice about entering the Indonesian horticulture subsector.

In addition to inviting investors, the Cipta Karya Bill also facilitates business licenses that previously had to pass through multiple layers of bureaucracy, from asking the Minister of Agriculture’s recommendations first to then requesting the Minister of Trade’s permission.

With the Omnibus work copyright, the process is simplified to become a business license from the central government.

In addition to allowing the entry of investments, the issue of seeding was also discussed in the bill. Felippa explained that so far the distribution of seeds was very limited, so farmers often had difficulty accessing quality seeds.

We certainly know that regulations in Indonesia have various roofs and doors, even to get one-roof service, but apparently there are still several doors that must be passed.

Previously, Article 63 of Law number 13 of 2010 concerning horticulture restricted seed income only when the seed could not be produced domestically or if domestic needs were not fulfilled and it had to go through a complicated licensing process.

The regulations that seemed complicated were then revised in the Work Cipta Bill so that the process of seed entry and removal could be easier.

The Omnibus Work Copyright Bill, can be said as a law that can be a solution to problems related to regulation, especially regulations on labor welfare and regulations on the licensing process for investors or investors.
