Accepting the PSU Results as a Form of Respect for the Constitution
JAKARTA – The revote (PSU) for the 2024 North Gorontalo Regent and Deputy Regent Election has marked an important success in Indonesia’s democratic journey. The decision of the Constitutional Court (MK) to reject the PSU results lawsuit is an affirmation that the entire process has been carried out in accordance with the rule of law and legitimate democratic principles.
The Chief Justice of the Constitutional Court, Suhartoyo, in his decision, stated that the petition of candidate pair number 1, Roni Imran-Ramdhan Mapeliey, could not be accepted. This is because the difference in votes between the candidate pair and the candidate pair with the most votes, Thariq Modanggu-Nurjana Hasan Yusuf, exceeded the maximum limit of 2% as stipulated in Article 158 Paragraph 2 Letter a of Law Number 10 of 2016.
MK Justice, Enny Nurbaningsih said in the verdict hearing that Candidate Pair Number 1, Roni Irawan-Ramdhan Mapaliey, did not meet the requirements to file a lawsuit.
“The difference in votes between the Applicant and the Related Party is 2,640 votes, while the maximum requirement is 1,475 votes. Therefore, the application does not meet the requirements,” explained Enny.
Meanwhile, other issues that are the basis for the lawsuit have also been denied by the Constitutional Court. Constitutional Court Judge Ridwan Mansyur stated that the alleged money politics accused of candidate pair number 2 were declared legally unproven. The diploma used by candidate for Deputy Regent Nurjana Hasan Yusuf is valid and issued by a legitimate institution.
“There is no evidence to convince the Court that there has been a violation in the form of structured, systematic, and massive money politics,” he said.
Meanwhile, the Coordinator of the Legal, Prevention, Community Participation and Public Relations Division of the North Gorontalo Bawaslu, Fadli Bukoting also emphasized that the entire supervision process in the PSU had been carried out transparently and accountably.
“The submission of this final report is a form of accountability to the public for the supervision work that has been carried out openly,” he said.
The submission of the report was accompanied by a member of the Gorontalo Province Bawaslu, Moh Vadjri Arsyad, and was received directly by a representative of the Indonesian Bawaslu. The affirmation of the Indonesian Bawaslu regarding the inadmissibility of the objection to the alleged TSM violation submitted by Candidate Pair 01 also validates that no serious violations were found in the PSU.
“The objection memo cannot be accepted. The process has been carried out in accordance with laws and regulations,” said the Head of the Gorontalo Province Bawaslu, Idris Usuli.
Appreciation for the implementation of the PSU was also conveyed by the Indonesian General Election Commission (KPU). KPU member, Yulianto Sudrajat, assessed that the success of the PSU could not be separated from the hard work and dedication of the KPPS and all parties involved.
“Support for the KPPS who maintain integrity and carry out their duties with full responsibility makes the PSU take place according to the principles of honest and fair elections,” said Yulianto.
Likewise, KPU RI member Iffa Rosita also invited all parties to accept the results of the PSU with an open heart.
“I hope all candidate pairs can be resigned and have a mature attitude in accepting the results of the vote acquisition,” he said.
The situation after the PSU in North Gorontalo was also reported to be safe and conducive. This success shows that the corrective mechanism in Indonesia’s democratic system is running well.
Accepting the PSU results is a reflection of political maturity and respect for the supremacy of law. In the spirit of maintaining stability and encouraging development, all parties are now expected to join hands, making the election results a foundation for developing the region and realizing community welfare.
