People Must Respect Re-vote According to Constitutional Court Decision

Jakarta – The implementation of the Re-vote (PSU) in the series of the 2024 Regional Head Elections (Pilkada) is part of the legal mechanism that must be respected by all elements of society. The decision of the Constitutional Court (MK) regarding the PSU is not a form of uncertainty, but rather a manifestation of a democratic system that provides room for correction to ensure justice and integrity in the election process.

The Chairman of the General Elections Commission (KPU) of the Republic of Indonesia, Mochammad Afifuddin, emphasized that the KPU is ready to face any lawsuits regarding the PSU results submitted to the MK. He stated that the implementation of the PSU by the KPU ranks in the regions had been carried out in accordance with the provisions of laws and regulations.

“In terms of implementation, the KPU believes that our friends in the regions have been very optimal in organizing the PSU,” said Afif.

He added that the KPU is ready to provide explanations and answers in every trial process at the MK. This shows the commitment of the election organizing institution to uphold transparency and accountability in every stage of the regional elections, including if the PSU results are disputed again.

Meanwhile, the Constitutional Court has read out an interim decision (dismissal) on seven cases of disputes over the results of the 2024 Pilkada PSU. Of the seven cases, only two were declared worthy of being continued to the evidentiary stage, namely the cases from North Barito Regency and Talaud Islands Regency.

The Chief Justice of the Constitutional Court, Suhartoyo, said that the parties in the case can present a maximum of four witnesses or experts at the evidentiary hearing scheduled for May 8, 2025. The list of witnesses and additional evidence must be submitted no later than one day before the hearing.

“For the parties who continue their cases, they can submit witnesses and experts. Whether they can be combined or each is allowed, the important thing is that the number does not exceed four,” said Suhartoyo.

This Constitutional Court decision also emphasizes that not all lawsuits will be accepted if they do not meet formal and material requirements. Therefore, the public is expected not to be provoked by narratives that undermine trust in the ongoing legal process.

In a democratic state based on the rule of law, respecting the decisions of judicial institutions is a form of democratic maturity. Communities in regions that are implementing PSU or whose cases are not continued by the Constitutional Court should maintain order and conduciveness, and continue to support the implementation of honest and fair regional elections for the progress of their respective regions.
