Rejection of the Job Creation Law Will Harm Labor

The Job Creation Law has been passed by the government where the previous regulation was in the form of Government Regulation in Lieu of Law (Perppu) 2/2022 concerning Job Creation to become law. But apparently there is still resistance from the Labor Party.

The President of the Labor Party has given instructions to carry out the action by stopping production, leaving the factory and then moving to one point.

In addition , another form of action in the regions is asking the Governor, Regents, Mayors together with the local DPRD to make an official recommendation letter addressed to the President and Leaders of the DPR RI.

Of course this action can be detrimental to the workers themselves, moreover demonstrations are indeed vulnerable to provocation, where workers who do not understand related to work copyright issues will still be herded to enliven the action.

At least there are several benefits that workers will receive if the Job Creation Law is actually implemented.

First , workers will get guaranteed job loss when the Job Creation Law applies. This is reinforced by the narrative from Airlangga Hartarto as the Coordinating Minister for the Economy who said that the purpose of the Job Creation Law is in accordance with the framework of article 4 and article 18 of the 1945 Constitution related to the protection and certainty of workers’ rights.

According to him , the job loss insurance program provides cash benefits and training for upgrading or reskilling, as well as access to information on the labor market.

Second , Airlangga also emphasized that workers’ rights will still exist in the Omnibus Law on theJob Creation Law, even though they are not included. One of them is menstruation leave.

In addition to menstruation leave, maternity leave for female workers is also available, although both are not included. So it is not true if there are those who still think that the Job Creation Law does not provide maternity leave to female workers.

Third , Indonesia is expected to be able to attract a lot of investment which will also have an impact on opening up employment opportunities. Investment Minister Bahlil Ladalia once said that there would be 154 investors.

Of course, with so much investment coming in, jobs will emerge which are certainly able to absorb labor. So that workers who are laid off will benefit because they can still apply for work.

Airlangga added, in the Job Creation Law it is stated that the government will help employees who have been laid off by providing various job training. In addition, if you haven’t found a job yet, the government will provide assistance in the form of cash which will be paid for six months by BPJS Employment.

Fourth , the Job Creation Law provides certainty of bonuses up to overtime hours. Airlangga said, in the Job Creation Law, one of them has regulated the bonus that workers will receive. The workers have even arranged overtime hours. The number of overtime hours has also been increased from three hours to four hours per day. This will certainly make workers more productive.

​Through the Job Creation Law, the government plays a role in helping workers affected by layoffs. Where workers will get assistance in the form of a salary from BPJS Employment.

​Sari Pramono as Chair of the Employment, Vocational and Health Division of the Central Governing Body (BPP) of the Indonesian Young Entrepreneurs Association (HIPMI), said the Job Creation Law would create more jobs. Indonesia’s workforce will also have a decent income.

​He believes that the Job Creation Law can create a conducive investment and business climate. Especially in the MSME industry, so that it can compete at the global level.

​Pramono said the ratification of the Ciptaker Law could reduce problems and obstacles for the industry. With the existence of the Omnibus Law, it is hoped that this regulation can attract investment interest in order to increase the capacity of the national MSME industry.

​It is estimated that the Job Creation Law will open around 46 million job vacancies once it is passed. Of course, with the composition of the Omnibus Law that has been designed in such a way, this is not impossible.

​Previously, news circulated that foreign workers were free to enter Indonesia. Of course, responding to this news, we should refer to Article 42 which states that every employer who employs foreign workers must have a plan for employing foreign workers (TKA) which is approved by the central government. The use of foreign workers is also determined for a certain period of time, and they are prohibited from occupying positions that manage personnel.

In addition , one of the disinformation that should be watched out for is the loss of all leave entitlements. However, in reality the right to leave and rest time still exists, in article 79. Annual leave is given at least 12 days for workers who have worked for 12 months, and is regulated in a work agreement or company regulations. Companies can also provide long breaks.

​Therefore , the action against the Job Creation Law will actually harm workers and also hinder the production process where workers work.
