The Legal Process for FPI Members is Transparent

The case of FPI members that occurred at KM 50 of the Jakarta-Cikampek toll road will be resolved as well as possible. After the reconstruction of the scene, the community knows what really happened. In that incident, the police’s actions were justified, because they were in self-defense. On the other hand, the FPI army was guilty of breaking the law.
The public was shocked when there was an incident on the Jakarta-Cikampek toll road. Moreover, there were casualties. FPI immediately got emotional and threatened to bring the case to the constitutional court, even before the international court. However, they could not move, because in this incident, firearms and sharp weapons were found belonging to members of the FPI laskar.
This discovery made the public even more aware that the police’s actions were correct. FPI cannot accuse that the officers acted violently. But on the contrary, the police took firm, measured actions in self-defense. Logically, how do you avoid attacks from the irregulars, when they are carrying firearms, if they don’t fire?
After the discovery of the firearms belonging to the paramilitary troops, a scene was reconstructed. In the reconstruction, it was described that members of the laskar had intended to shoot the police first, and were trying to seize firearms from the security forces. They even laugh when they do it. But finally things turned around and they were successfully paralyzed.
National Police Commission member Poengky Indarty stated in the Chief of Police Regulation number 8 of 2009 and the Chief of Police Regulation number 1 of 2009, that the use of firearms can only be used to protect human life. The condition is that they must be used in a state of defense against the threat of serious injury or death or to prevent serious crimes from occurring.
Judging from the 2 regulations, the police have taken the right action, because they defend themselves when threatened by other people. The choice is only to lose life or lose life. So that measured decisive action is indeed allowed, and does not violate human rights. In a precarious situation, the use of a gun is allowed.
This case has been brought to the National Commission on Human Rights by FPI officials, but they are embarrassed. The reason is, Komnas HAM Chairman Ahmad Damanik mentioned the voice recording at the time of the incident. It turned out that the fact was found that the FPI laskar enjoyed a shootout with the security forces. In that sense, the laskar had bad plans for the police from the start.
This fact from the National Human Rights Commission overturns FPI’s accusations that it was their party who was kidnapped and lost their lives arbitrarily. FPI deliberately made a hoax that the army was the victim. There are even photos spread on social media and it is said that the bodies of the army are smiling. Even though it’s a fake photo and the person is still alive, and not the one in the car when the incident happened.
Director of General Crimes, Brigadier General Andi Rian Djajadi, stated that the 6 FPI members who lost their lives during the incident on the Jakarta-Cikampek KM 50 toll road were made suspects by the National Police Criminal Investigation Unit. Because they were proven to have violated Article 170. But the court will decide what to do next.
Brigadier General Andi continued, the case file will be transferred to the prosecutor. To stop the case, it can be at the prosecution stage, it can be investigated. Meanwhile, for the alleged unlawful killing, the investigator has made a prison and is under investigation to seek preliminary evidence. The basis for the investigation is Article 351 paragraph (3) and Article 338 (KUHP).
When there is a bloody incident on the Jakarta-Cikampek KM 50 toll road and it is clear that the scene is recreated, it shows transparency by the Police. They did not cover up what actually happened at that time. The public can also update about this case, because there is always an explanation from the public relations of the National Police, and they are relieved to know the facts.
