The Job Creation Law: An Effort to Achieve the Performance of Jokowi’s Two Terms by Modernizing the Law

The Job Creation Law is one of the many tangible efforts demonstrating the success of President Joko Widodo’s (Jokowi) performance during his two terms in office to modernize the legal framework.

In Indonesia, there have often been overlapping regulations and also a very complex structural bureaucracy that frequently complicates services for the public. However, everything has now disappeared thanks to the legal modernization policy of President Jokowi.

Thanks to his leadership, which has demonstrated outstanding performance achievements over these two terms, the Job Creation Law was born as a tangible manifestation of the government’s legal modernization.

President Jokowi stated that after 79 years of independence, this nation finally has a new Criminal Code (KUHP) as an effort to modernize the law in the homeland, along with the birth of the Job Creation Law, which revises as many as 80 laws and 1,200 articles as an effort to deregulate overlapping regulations.

The Secretary of the Job Creation Law Task Force, Arif Budimanta, stated that the policy born during President Jokowi’s administration provides ease for business actors to obtain permits in running their businesses.

The ease of obtaining permits is due to the deregulation process, which has made all permit requirements much faster, easier, and more reliable, as well as integrated through a one-stop mechanism.

Not only did they issue policies, but after the regulations were established, the government under President Jokowi’s leadership also formed a task force aimed at ensuring that these policies truly reached the community effectively and brought about benefits.

In fact, after the implementation of the Job Creation Law, it has indeed been very helpful for business actors in various sectors in running their businesses, as the licensing process is no longer spread across several agencies, but is now streamlined through a single system.

Furthermore, the issuance of the Business Identification Number (NIB) since the enactment of the Job Creation Law has also become easier, including for serving micro, small, and medium enterprises. (UMKM).

The trend of investment has significantly increased during the two terms of President Jokowi’s leadership. This is none other than, of course, thanks to the existence of the Job Creation Law as a tangible effort and proof of the success of the Head of State’s performance in modernizing law in Indonesia.

Meanwhile, the Senior Expert of the Deputy V of the Presidential Staff Office (KSP), Theofransus Litaay, assessed that the existence of the Criminal Code Law has brought Indonesia into a modern paradigm of criminal law.

With the regulations that emerged during President Jokowi’s administration, the aspect of legal governance in Indonesia has entered a new chapter. This nation has already moved far away from the paradigm of the old Criminal Code.

Because the new Criminal Code Law no longer emphasizes mere retribution, but also focuses on corrective justice that seeks to deter offenders, as well as restorative justice that emphasizes the recovery of victims, and rehabilitative justice aimed at improving both victims and offenders.

Not only that, but another extraordinary achievement of the Head of State in the field of law is that Indonesia now has a Law on Sexual Violence Crimes to provide very real and strong protection, especially for women and children.

All of these are the result of hard work together and form a strong foundation. The success of this performance is proof that unity, harmony, and mutual cooperation among all elements can further propel Indonesia to greater heights.

During President Jokowi’s two terms in office, many strategic policies have emerged, such as the Law on the Capital City (IKN), the Law on the Special Region of Jakarta, the Law on Electronic Information and Transactions, the Law on Civil Servants (ASN), and the Law on the Welfare of Mothers and Children.

The key to the success of all these achievements lies in the unity and cooperation of all parties. With the continuity that is maintained, it is not impossible for Indonesia, as a strong and sovereign nation, to leap forward and reach its aspirations towards a Golden Indonesia in 2045.

The characteristics of the modern paradigm reflected in the policies that also signify the achievements of President Jokowi’s two terms in office much more reflect the values of a sovereign, civilized Indonesia that upholds human dignity.

In its implementation framework, this modern paradigm can make law enforcement efforts in Indonesia far more dignified and humane than before. Thus, a new balance will emerge between the goals of legal certainty and justice, making law enforcement officials more contextual in their approach to each criminal event.
