OMNIBUS LAW, SUPPORT OR REFUSE?
By : Rashka Pratama
Omnibus law is a law created to target one major issue that might revoke or amend several laws at once so that it becomes simpler. This legal term is currently rife in Indonesia. Because the Indonesian government is preparing an omnibus law whose ultimate goal is to encourage national economic growth.
In the last limited meeting on the Omnibus Law in December 2019, President Joko Widodo had said that the substance of the bill was related to 11 clusters involving 30 ministries and institutions. Therefore, the president requested that the big vision and framework of this draft bill have a clear focus and remain consistent, so that it would be synchronous and integrated. The President does not want the Omnibus Law Bill to be a place to accommodate the desires of ministries and institutions.
Furthermore, the President also instructed the Attorney General, the National Police, and BIN to see the impact of this Ornnibus Law Bill. Therefore, the discussion of the Omnibus Law Bill must be carried out together with all stakeholders. In addition, Jokowi also asked his staff to prepare regulations derived from Omnibus Law. Namely, in the form of a draft government regulation, revised PP, or draft presidential regulation.
After the Draft Omnibus Law was approved by the House of Representatives, the President requested that his staff immediately speed up the execution process on the ground. One of the omnibus law that was formed was related to labor, which discusses wage schemes calculated based on working hours.
Although this scheme has been rejected by a number of groups, especially labor organizations, the goal of the establishment of this regulation is very good, namely to improve the welfare of Indonesian workers. All regulations drawn up will not immediately provide tangible benefits, need maximum time and support from all parties in it.
