Workers and Citizens Support the Omnibus Law Policy for the Welfare and New Employment

The Jokowi-Ma’ruf government continues to strive to facilitate investment licensing with the Omnibus Law scheme. The application of the Omnibus Law is believed to be able to encourage the investment climate and the Indonesian economy. In addition, the Omnibus Law is also predicted to be able to provide protection for workers and employers.
In this second period, President Joko Widodo paid great attention to investment, even in the short time until the end of his administration, Jokowi had held a limited meeting related to investment as much as 2 times. This was done to boost the realization of investment that has not increased in recent times and has become an obstacle in preparing the pace towards Indonesia Forward.
If the value of investment in Indonesia increases, it will certainly have a positive impact on employment, especially with the many productive ages in Indonesia, of course this will be a special attraction for employers and investors.
Pelita Harapan University law and economics expert, Maria Soetopo, said that Indonesia could use the Omnibus law legal system. Even though the legislation formation law does not accommodate that provision, its application can use the concept of omnibus-hybrid or quasi omnibus law “Omnibus law can be applied in civil law countries because Perpres 87/2014, Article 44, reads’ Authority is given to every ministry / institutions to carry out planning, drafting of laws and regulations’. The omnibus law scheme can be used for deregulation in order to avoid overlaps and bring about efficiency in policy implementation. Although the Law on the formation of legislation does not accommodate the formation of omnibus law, it can still be done by creating the concept of omnibus-hybrid or quasi omnibus law or the merging of the common and civil law system.
Omnibus law is a breath of fresh air to improve the investment climate, so that it becomes an attraction for investors entering Indonesia. Other benefits in the application of the Omnibus Law will also be felt by workers, where in the future workers do not need to worry if something unexpected happens such as termination of employment (FLE). Therefore, the community together with citizens also supports the Onimbus Law policy for the creation of a reliable business world and the opening of employment opportunities and improving the welfare of the workforce.
