Two Australian drug smuglers who are part of the Bali Nine convicts, Andrew Chan and Myuran Sukumaran, seems to face their death penalty execution soon in NusaKambangan Island, Indonesia after an Indonesian court rejected their last-ditch challenge on Monday,6 April 2015.
Their lawyer try to challenge Indonesian President Joko Widodo’s rejection of their clemency pleas. They said that, Mr. Widodo had not given adequate consideration to the men’s cases. “They have the right to live, and the state attorney knows that [the law] allows them to defend their lives,” the convicts’ lawyer, Leonard Arpan said. “We will continue our legal efforts”. They tend to take their case to the constitutional court.
The head of the state lawyers team, Novarida said those guys only have a very limited option left in their hands. “There is no more legal recourse,” he said. It is not sure where the case will be proceed after this. State Administrative Court in Jakarta is still with its earlier decision, that said it had no authority to take the case. Some analysts said once a death row convict’s clemency has been rejected by the president, it seems impossible to fight against that decision.
Many diplomatics ways have been done by Australia to revoke the two Australians death penalty. In February, six of Australia’s former prime ministers made a united plea for Indonesia to spare their lives, but Mr. Widodo kept up his decision to have no mercy for drug offenders as he said Indonesia faces a “drug emergency.”
Not only Australia, Indonesia also faced many critisicm from other countries which their citizen faced the execution, such as: Brazil, France,Ghana, Nigeria and the Philippines.
