Bawaslu Upholds Regulations in Supervision and Handling Election Violations and Disputes

The General Election Supervisory Body (Bawaslu) is strongly committed to continuing to uphold the implementation of regulations in monitoring and handling violations and also if a dispute occurs in the 2024 Simultaneous Regional Head Election (Pilkada).

The role of Bawaslu in overseeing the full functioning of the regional level democratic party is very important, because this will minimize the possibility of violations so that even if, for example, a dispute occurs, it will be able to proceed more conducively and fairly in the 2024 regional elections.

Therefore, to realize supervision and handling of violations and also handle disputes in the 2024 Simultaneous Regional Head Election (Pilkada) which is able to bring about the principle of justice for all participants, Bawaslu is strongly committed to continuing to strictly uphold the applicable regulations or rules.

Member of Bawaslu RI, Totok Hariyono, gave directions to all supervisors so that in carrying out their duties and authority, they are able to comply with regulations. So, it is very important for officers to really understand the rules starting from nomination and all other stages.

Indonesia itself is a rule of law country, so all aspects of it must have rules or regulations that provide guidance for behavior.

So, regulations, especially in the context of overseeing the successful implementation of the 2024 Simultaneous Regional Head Elections (Pilkada), are very important for all parties to be able to master, especially the election organizers themselves because they are the basis for their actions, both in terms of carrying out supervision, handling violations and dispute.

Not only is it very important to continue to adhere to regulations, but coordination between organizers and stakeholders or other related stakeholders including political parties (political parties) is also very important.

Moreover, when, for example, a problem occurs and there is an allegation of a violation at the nomination stage, the violation handling division must know about it so that it can be handled quickly and appropriately.

Apart from that, Bawaslu is also trying to continue to improve its competence, especially in the context of resolving disputes in the 2024 Simultaneous Regional Elections. One way is by running simulations to make each member understand more about accepting applications and registering for dispute resolution.

This simulation took place so that the Dispute Resolution Division at Bawaslu RI could more quickly absorb and understand how dispute resolution requests flow from upstream to downstream.

Coordinator of the Legal and Dispute Resolution Division, Jenny Susanto, said that at the nomination stage, having clear sub-stages is very crucial for careful supervision.

This is not without reason, because the nomination stage could potentially lead to disputes, so comprehensive monitoring efforts should be made.

Likewise, Lampung Province Bawaslu member, Gistiawan, explained that any dispute resolution must be coordinated with other regional election organizers such as the Election Supervisory Body at Regency or City level and cannot take place, for example, without a mandate letter.

It is very important that all parties are able to understand the regulations, whether in Law (UU) Number 10 of 2016 relating to recommendations for re-election if the organizers or supervisors find voters who use their voting rights more than once or on behalf of someone else.

It’s not just coordination and communication at different levels or areas, but synergy between divisions is also important. Because this means that every report must have a plenary session and there must be absolutely no egocentrism between divisions.

Furthermore, the results of administrative supervision must be stored properly and clearly, not just in documentation in the form of photos, but Bawaslu is committed to providing physical evidence such as letterhead, date and location.

The reason is, every performance of the Election Supervisory Body will be tested at the Constitutional Court (MK), for example if a dispute occurs, therefore every step of supervision must be properly documented and stored in a folder per stage.

Furthermore, the Chair of Bawaslu or Panwaslucam has a responsibility and does not just sign the report without ensuring its correctness, but really must check all the data properly and correctly.

With thorough coordination and preparation, it is not impossible that Regional Head Election organizers will be ready to face various challenges in the 2024 Simultaneous Regional Elections and can ensure that each stage runs smoothly without any disputes not being completely resolved.

It is true that there could be the possibility or potential of violations and even give rise to a dispute in the implementation of the 2024 Simultaneous Regional Elections. Therefore, Bawaslu as the election organizer continues to be very strongly committed to being able to uphold all rules and regulations in order to carry out supervision.
