The Job Creation Law is a Form of Protection for Workers

The government and the DPR have officially passed the Job Creation Law. With the publication of these regulations, the Government seeks to increase the protection of workers, one of them Adala h awarding compensation guarantee.

              The DPR officially passed the Job Creation Law after a long road and involved many parties. The Job Creation Law is considered a global sweeping regulation because it can summarize many overlapping regulations. In addition, this law also provides certainty for severance pay, whereby the government implements the JKP program without reducing the benefits of JKK, JKm, JHT and JP, and does not increase the burden of contributions from workers or employers.

              The Minister of Manpower (MENAKER) Ida Fauziyah guarantees that the Job Creation Law (UU) continues to prosper workers, as stated in the substance of the old Law.

              Ida said, all the provisions of the specific time agreement (PKWT) in Law 13 of 2003 are the same as those in the omnibus law. In fact, the Work Creation Law stipulates that the protection for contract workers must be the same as the provisions for permanent workers, namely the right to compensation when the contract has been completed.

              He also admitted that not a few workers met him and protested the ratification of the Job Creation Law .

              This, he realized, was because many workers did not fully understand the Job Creation Law, so that many misunderstandings were found about the substance of the law.

              He gave an example regarding life contract workers. In fact, in the Job Creation Law there is no provision that regulates this, because the maximum limit for the contract period will be regulated in government regulations, it can be faster to become a permanent worker, or it could be slower.

              Therefore, Ida invites all parties to maintain conduciveness, even though they are not satisfied with the Job Creation Law which has gone through the knock-on-hammer phase by the DPR RI.

              Ida also invited the public to keep a cool head on this. If anyone is not satisfied with the Job Creation Law , Ida said that the dissatisfaction could be sued at the Constitutional Court.

              He also invited all parties to maintain conditionality, even though he was not satisfied with the Job Creation Law that had been passed by the Indonesian Parliament.

              Eki assessed that workers should indeed see other opportunities and options amid the uncertain economic climate that occurs. The Job Creation Bill which focuses on empowerment, protection of micro, small and medium enterprises, MSMEs, ease of doing business, should be a way out so that workers can be freed from dependence on companies.

              He also argued that if he only depended on the company, this would be an example of workers who, according to him, were not free. This Job Creation Bill provides wide opportunities, so that workers really need to see the opportunities that arise and take advantage of them.

              Meanwhile, Termination of Employment (PHK) is indeed a scourge for many employees or laborers, even though they receive severance pay, this is still a threat in itself because those who are laid off must continue to struggle to find work so that they can support their families.

              The Job Creation Law hopes to rise from a downturn / critical phase during the pandemic. With the passage of this law, workers and workers do not have to worry about messages and various disinformation news that spreads in various media. So that understanding the substance of the Job Creation Law is important before determining the attitude towards the ratification of the law that is still in the labor cluster.
