Whereas in these two values, it is clear that all people in the country should be able to respect each other if there are differences from one another so that divisions do not occur between fellow citizens. Therefore, of course, people should be able to protect each other’s words and actions so that they do not offend, let alone humiliate and insult the dignity of others.

As it is known that recently the public has been very excited about how the case dragged down the name of Rocky Gerung, because he was suspected of insulting President Joko Widodo (Jokowi), which then suddenly went very contrary to the noble values ​​of the nation and caused potential uproar in the midst of public.

The Directorate of General Crimes for the Investigation and Criminal Agency of the Indonesian National Police (Dittipidum Bareskrim Polri) then revealed that the number of reports to the security forces against political observers was increasing day by day. Most recently, there have been 21 reports against him.

In this regard, the Director of General Crimes (Dirtipidum) Bareskrim Polri, Brigadier General of Police (Brigjen Pol) Djuhandhani Rahardjo Puro explained that the report submitted to the police came from Bareskrim or the Regional Police (Polda).

In the details of the report to Rocky Gerung, it is known that as many as 2 (two) police reports were received at Bareskrim Polri, then 4 (four) of them were addressed to Polda Metro Jaya and 3 (three) other reports were in North Sumatra Province (North Sumatra) . Furthermore, as many as 7 (seven) police reports were in East Kalimantan Province (Kaltim), 3 (three) reports were in Central Kalimantan (Kalteng) and as many as 2 (two) other reports were in the Special Region of Yogyakarta (DIY).

For now, the position of all these reports has indeed been withdrawn to the Bareskrim Headquarters (Mabes) of the National Police and now the case involving the name of the former lecturer at the University of Indonesia (UI) is being investigated because all of these reports have the object of the case and also the name of the reported person. Reports from the public regarding Rocky Gerung are known to be the impact or long-term impact of his statements in the public space and digital space, which are considered by some to contain elements of SARA-based hatred and are also considered to have insulted the current Head of State. still legally in office and protected by the constitution.

Law (UU) Number 1 of 1946.

Article 14 Paragraph (1) of Law 1/1946 reads, “Anyone who, by broadcasting false news or notifications, deliberately causes confusion among the people, is punished with a maximum prison sentence of ten years.” In Article 14 Paragraph (2) it reads “Anyone who broadcasts a news or issues a notification, which can cause uproar among the people, while he should be able to think that the news or notification is a lie, shall be punished with a maximum imprisonment of three years.

Then, Article 15 of Law 1/1946 reads “Anyone who broadcasts news that is uncertain or news that is excessive or incomplete, while he understands that at least he should be able to suspect, that such news will or can easily cause trouble among the people, is punished with maximum imprisonment of two years.” Of course, it cannot be denied that all elements of society in Indonesia are very worried about the case in the form of actions and words put forward by Rocky Gerung because they are considered very insulting to President Jokowi. Therefore, because there are indeed many people in the community who strongly criticize this matter, it is not surprising why the number of reports to political observers continues to increase.p
