Support the Implementation of Dispute Hearings by the Constitutional Court, Provide Legal Certainty for Regional Election Results

Jakarta – The Constitutional Court (MK) held the first hearing on the 2024 Regional Head Election (Pilkada) results dispute on Wednesday, January 8, 2025. Of the total 314 applications received, 242 cases were disputes over regent elections, 49 were disputes over mayoral elections, and 23 were disputes over gubernatorial elections. The Chief Justice of the Constitutional Court, Suhartoyo, emphasized that his party had prepared strategic steps to ensure the process was fair and transparent.

“The data on PHPU applications from regional heads to date total 314 applications. We have made various preparations to ensure smooth trials and legal certainty for all parties involved,” said Suhartoyo in an official statement at the Constitutional Court Building.

MK’s preparations include regulatory updates, improving procedural procedures, and modernizing trial facilities. In addition, technical guidance on procedural law for stakeholders in the 2024 Simultaneous Regional Elections has been implemented. A special task force was also formed to support the smooth running of the dispute resolution process.

MK Secretary General Heru Setiawan added that ad hoc staff had been assigned to assist in handling the case.

“A total of 60 interpreters, five translators, and three writers have been sworn in. They will support the trial process with high integrity,” Heru explained.

The use of technology is one of the MK’s focuses in creating a modern and transparent justice system. Trial minutes, both in audio and text form, will be uploaded and can be accessed by the public. This step is expected to strengthen public trust in the ongoing legal process.

On the other hand, the General Election Commission (KPU) is also preparing to face the trial. KPU Commissioner, Iffa Rosita, said that her party had given direction to the Provincial KPU to prepare a chronology and mapping of the dispute, as well as ensure the readiness of the budget and human resources.

“The Central KPU continues to provide assistance to strengthen regional KPUs in facing the trial,” said Iffa.

The implementation of the Pilkada dispute hearing is expected to provide legal certainty over the election results. In this context, the Chief Justice of the Constitutional Court, Suhartoyo, appealed to all parties to respect the ongoing legal process.

“We are committed to deciding the case fairly without any influence whatsoever,” he stressed.

With thorough preparation, the Constitutional Court is optimistic that it will be able to resolve the 2024 Pilkada dispute effectively, fairly, and transparently. This is also real evidence of the Constitutional Court’s commitment to maintaining the integrity and public trust in the democratic process in Indonesia.
