The existence of a Government Regulation in lieu of a Job Creation Law (Perppu) is able to provide certainty as well as firmness to further support the smooth investment climate that is much needed by the country, especially in 2023 amid all the ongoing global uncertainties.
Because in order to be able to fill the legal vacuum of the Job Creation Law (UU) which had previously been declared conditionally unconstitutional through a Constitutional Court (MK) Decision, President Jokowi then issued Perppu Number 2 of 2022 concerning Job Creation which he ratified on Last December 30, 2022.
The existence of the Job Creation Perppu which was ratified by President Jokowi at the same time revised a number of rules that were in Law Number 11 of 2020 concerning the previous Job Creation. Regarding this matter, the President stated that even though it appears as if the situation seen in Indonesia looks normal, actually at this time the country is still overwhelmed by global uncertainty.
Therefore, knowing how dangerous the threat of global uncertainty is, then the reason for the Government of Indonesia to issue the Job Creation Perppu. In fact, President Jokowi himself admitted that he had repeatedly stated that now there were as many as 14 countries that were patients of the International Monetary Fund (IMF), and there were also as many as 28 countries that had queued at the IMF’s doorstep because they were very threatened by turmoil. this world economy.
Furthermore, President Jokowi explained that the world is currently in a bad condition. There are still several threats of risk of uncertainty in the future which continue to envelop. Because of this, the Government immediately made efforts to be able to anticipate it through the issuance of the Job Creation Perppu to be able to provide more legal certainty and fill the legal void left by the previous Ciptaker Law, especially to investors both from within and outside the country so that they can be sure of doing investment in the country.
The reason is, it cannot be denied that with the legal certainty provided by the Job Creation Perppu in replacing the position of Law Number 11 of 2020 concerning Job Creation, it is able to create a good perception from investors. Meanwhile, the trust of investors themselves is something that is really needed by the country because according to President Jokowi that in 2023, Indonesia will indeed depend heavily on export and investment activities for its economy.
Meanwhile, the CEO of Wyr Solution, Theodorus Wiryawan, has high hopes for the Job Creation Perppu. According to him, the presence of the Perppu signed by President Jokowi is able to minimize uncertainty in the midst of the global economic turmoil and also the dynamics in the 2023 political year to welcome the 2024 General Election (Pemilu).
He did not object at all to the Perppu Cipta Kerja because he considered that this policy was able to improve the mood of investors and business people to continue carrying out their investment and business activities. Theodorus Wiyawan added that currently there are indeed many entrepreneurs who tend to wait and see, so according to him the Perppu Cipta Kerja will be very much needed because it is a policy and a firm and certain step in resolving this problem.
On the other hand, the Coordinating Minister (Menko) for the Economy, Airlangga Hartarto said that the issuance of the Job Creation Perppu carried out by the Government of Indonesia was carried out by considering many things, mainly regarding the urgent need in an effort to anticipate global conditions, whether it is related to economic conditions or conditions of geopolitical turmoil.
According to him, the government needs to immediately accelerate anticipation of all global conditions, especially the threat of a global recession, rising inflation to the point of stagflation, all of which must be able to anticipate with the right steps.
The Coordinating Minister for Airlangga also said that the Constitutional Court (MK) Decision Number 91/PUU-XVIII/2020 regarding the Job Creation Law (UU) greatly influenced behavior in the business world, both those from within the country itself and those from abroad. country. Whereas on the other hand, the Government wants to continue to attract investment because it is one of the keys to economic growth.
The Government has carried out certainty and firmness to really support the smooth investment climate in Indonesia, one of which is by issuing Perppu Number 2 of 2022 concerning Job Creation because it replaced the position of the previous Ciptaker Law which was considered conditionally unconstitutional so as to be able to fill the legal vacuum in order to create perceptions good for business people and investors for the development of the national economy in the midst of global uncertainty.
