The stability of the national economy is increasingly maintained thanks to the establishment of the new Job Creation Law (UU) by the Indonesian Government and the Indonesian Parliament. This also makes investors more determined to invest their capital in the country, including providing certainty of welfare to workers.

The changes to Law (UU) Number 11 of 2020 through Law (UU) Number 6 of 2023 concerning Job Creation (UU Job Creation) were indeed carried out by the Government of the Republic of Indonesia (RI) to be able to continue to harmonize various kinds of legal regulations. existing invitations.

However, not only in order to harmonize various regulations, but it turns out that changes to the regulations related to Job Creation (Ciptaker) are also able to answer current legal needs, in order to continue to maintain the stability of the national economy, which is currently in dire need. the existence of a clear legal umbrella as a basis for policy making by the Government.

Regarding the existence of the new Job Creation Law, Member of Commission III of the House of Representatives of the Republic of Indonesia (DPR RI), Supriansa revealed that based on the Decision of the Constitutional Court (MK) Number 91/PUU-VIII/2020, the implementation of the Law (UU ) Number 11 of 2020, after the decision of the Constitutional Court occurred, of course this resulted in a condition where norms were ineffective.

Apart from that, the Constitutional Court’s decision regarding the status of the old Job Creation Law also created a condition of uncertainty regarding the implementation of Law Number 11 of 2020 and was able to give rise to disputes among business actors, workers and the public regarding economic law, the business world and investment. In response to all the chaos, Government Regulation in Lieu of Law (Perppu) Number 2 of 2022 was issued.

Of course, with the various conditions that have occurred, the urgent nature of the issuance of Perppu Number 2 of 2022 has been fulfilled and at the same time answered questions from several parties who asked about the critical situation referred to in the formation of the Perppu.

Then now, with Law Number 6 of 2023 as the legal basis which states that Perppu Number 2 of 2022 becomes a piece of legislation carried out by the DPR RI in order to avoid legal vacuums and provide updates on legal certainty, considering the validity period of the Presidential Decree. short, if it is not immediately approved by the DPR RI, then ratification will be carried out immediately.

In ratifying the regulation itself, the public has been given full rights to be able to contribute their input either verbally or in writing which can be done through public hearings, work visits, outreach and seminars. Of course, this public consultation will then be used as material for consideration in the draft discussion at the next stage.

Meanwhile, the Vice President of the Republic of Indonesia (Wapres RI), KH Ma’ruf Amin, also emphasized that the existence of the new Job Creation Law is an effort to follow up on the Constitutional Court’s decision which states that Law Number 11 of 2020 concerning Cipataker is conditionally unconstitutional.

So the existence of Law Number 6 of 2023 concerning the new Job Creation is a way out of the problems that previously occurred. Apart from that, it turns out that the existence of this new regulation in the economic world is also very much needed because it can help maintain national economic stability.

This is because currently, after the issuance of the new Job Creation Law, the situation is slowly starting to improve and is no longer stagnant, apart from that, there is absolutely no vacuum in economic activity in the country so that national economic activity remains maintained with the certainty given to every action of investors to invest their capital.

It is clear that the existence of Law Number 6 of 2023 is the best form of solution that is able to overcome all situations that have previously occurred.

Likewise, the Deputy Minister of Manpower (Wamenaker RI) Afriansyah Noor also explained that now economic stability has been maintained optimally after the enactment of the new Job Creation Law by the Indonesian Government. How could it not be, because having clear rules creates stability regarding workers and how they are paid.

Because it also fully regulates in detail how employment regulations and all derivatives of these regulations are able to be sustainable with each other and become a buffer for future legal products (UU).

After the enactment of Law Number 6 of 2023 concerning Job Creation as a replacement for the old Job Creation Law, which was deemed by the Constitutional Court (MK) decision to be conditionally unconstitutional some time ago, now the situation and conditions of national economic stability have become even more secure.
