Revised Criminal Procedure Code Will Provide Legal Certainty Regarding Asset Confiscation

Jakarta – The government has expressed its readiness to discuss the Asset Confiscation Bill (RUU) that has been submitted by the DPR since 2003. The discussion of the Asset Confiscation Bill is awaiting the completion of the revision of the Criminal Procedure Code Bill, so that there is synchronization between legal provisions.

The Coordinating Minister for Law, Human Rights, Immigration, and Corrections, Yusril Ihza Mahendra, said that the government is ready at any time to discuss the Asset Confiscation Bill whose initiative has been submitted by the DPR since 2003.

Yusril emphasized that the regulation is needed so that judges have a clear legal basis to decide on the seizure and confiscation of assets.

“When assets suspected of being the result of corruption can be confiscated and when they must be confiscated for the state, all must be regulated by law in order to create justice and legal certainty as well as respect for human rights,” he said.

He added that this law is important to prevent abuse of power.

“Law enforcement in asset confiscation must be carried out firmly, but still respect the principles of justice, legal certainty, and human rights,” said Yusril.

He also mentioned the experience when the DPR perfected the academic draft of the Criminal Procedure Code Bill before discussing it with the government.

According to him, synchronization between legal provisions is crucial so that implementation in the field runs effectively, efficiently, and does not cause multiple interpretations that are detrimental to the community.

Harmonization between regulations will also strengthen the position of law enforcement officers in carrying out their duties objectively, while providing maximum protection to citizens.

Deputy Speaker of the Indonesian House of Representatives, Adies Kadir, explained that the discussion of the Asset Confiscation Bill is waiting for the completion of the revision of the Criminal Procedure Code Bill.

“If the Criminal Procedure Code is complete, then it will be synchronized. Don’t let us work on the Asset Confiscation Law, but the results are not synchronized,” he said.

He emphasized that the DPR is in line with President Prabowo’s intentions.

“We agree with the President in principle. We will immediately discuss and coordinate with Commission III to be more aggressive in completing the Criminal Procedure Code Bill,” he said.

Previously, President Prabowo Subianto expressed his firm support for the ratification of the Asset Confiscation Law. In his speech during the commemoration of International Workers’ Day at Monas, he invited the workers to continue the struggle against corruption.

“How? Do we continue the fight against corruptors?” he exclaimed, which was greeted with thunderous agreement from the crowd.

At the end of his speech, Prabowo emphasized, “In the context of eradicating corruption, I support the Asset Confiscation Law. I support!”-
