Ternate-The new Criminal Code (KUHP) will become effective in 2025 or three years after it is enacted. The Government’s commitment to provide socialization and education to the public regarding the Criminal Code continues to be intensified.
The Indonesian Criminal Law and Criminology Society ( Mahupiki ) held socialization of the new Criminal Code in Ternate, North Maluku, on Monday (30/1/2023).

Prof. Dr. Marcus Priyo Gunarto, SH, M.Hum , explained that one of the advantages of the new Criminal Code is that there are only two books, namely a book on general provisions and a book on two criminal acts.
“Our Criminal Code now only has 2 books. In the WvS there are 3. General provisions. The first book, the second book is about crimes, the third book is violations,” said Prof. Marcus.
“So why are they only divided into 2? Namely one general provision 2 regarding criminal acts. Because the difference between crime and violation in the context of law enforcement is not seen as too urgent.” Connect Prof. Marcus.
As is known, the new Criminal Code is still in a transitional period for three years since it was enacted and will come into effect in 2025. According to him, during the three years of socialization before the new Criminal Code was implemented, the reaction would continue until it was implemented, there would also be a reaction from the community.
He also added that there are differences in the new Criminal Code with the current Criminal Code. Compared to the Dutch-made Criminal Code, the new Criminal Code has many advantages.
Meanwhile, dr. Dhahana Putra said that there are five missions of the new Criminal Code, namely open recodification , harmonization, modernization, actualization, and democracy.
“There are five missions from the new Criminal Code, namely the first is open recodification and also still acknowledging related to other laws that are regulated related to criminal provisions,” he said.
On the same occasion, Lecturer at the Faculty of Law, University of Indonesia, Dr. Surastini Fitriasih SH, MH explained that the WvS Criminal Code uses Dutch and many interpret it however they want. Meanwhile, the new Criminal Code uses Indonesian which is an advantage.
“What is certain is the advantage, one of the most obvious and the easiest is because it uses Indonesian,” explained Dr. Surastini .
