Presents Various Legal Experts, Mahupiki Holds Socialization of the National Criminal Code in Ternate

Ternate — Presenting various legal experts and professors, Mahupiki held socialization activities related to the National Criminal Code in Ternate, North Maluku, Monday (30/1/2023).

The Indonesian Criminal Law and Criminology Society ( Mahupiki ) continues to hold a series of socialization activities regarding the National Criminal Code (KUHP) in several regions in Indonesia.

Most recently, they carried out the socialization activity in Ternate, North Maluku, on Monday (30/1).

Acting Director General of Legislation was also present at the event Kemenkumham , Dr. Dhahana Putra, Bc.IP , Chairman of the Senate of the Faculty of Law, University of Indonesia (FH UI) Dr. Surastini Fitriasih, SH,. MH and Professor of Criminal Law at Gadjah Mada University (UGM) Prof. Dr. Marcus Priyo Gunarto.

In his presentation, Dr. Dhahana Putra conveyed the long journey of drafting a new Criminal Code.

“So if we talk about it now, we have experienced a long struggle. Already 7 presidents, 7 governments, 15 ministers of law and human rights or justice, 17 professors or experts have died. It’s been a long struggle,” he said.

He also said that the new Criminal Code also carries five missions, namely open recodification , harmonization, modernization, actualization, and democracy.

“There are five missions from the new Criminal Code, namely the first is open recodification and also still acknowledging related to other laws that are regulated related to criminal provisions,” said Dhahana.

“Second, this harmonization is also quite interesting when Indonesia has a commitment related to human rights.” he continued.

Meanwhile, dr Surastini Fitriasih, SH MH said that the new Criminal Code is very modern and in accordance with universal criminal law.

“There are several advantages of the new Criminal Code which is a criminal law and a modern criminal system,” said Dr Surastini .

In the same vein, UGM Professor of Criminal Law, Prof. Dr. Marcus Priyo Gunarto explained that there are novelties that can be highlighted in the new Criminal Code, one of which is regarding Customary Law or Living Law.

“Regarding the recognition of customary law, I would like to add that customary offenses or customary criminal law are actually a characteristic of Indonesian criminal law,” he said.
