Maintain Harmony During Legislative Election Dispute Hearings

Legislative elections (Pileg) are important moments in a country’s democracy, but are often filled with tension and disputes. To maintain harmony during legislative election dispute hearings, wise attitudes and strong commitment are needed from all parties involved. In dealing with differences of opinion and conflict, it is important to prioritize constructive dialogue and prioritize common interests for the stability and integrity of the democratic process.

The Constitutional Court (MK) again became the center of public attention when it held a hearing on disputes over general election results (PHPU) or disputes over the results of the 2024 legislative election (Pileg) on ​​Monday (13/5/2024). The trial is a crucial stage in resolving disputes that may arise in the election process.

With a number of cases being heard, the MK acts as the highest law enforcement agency which has the authority to decide election disputes that may threaten the integrity of democracy.

Based on data from the Constitutional Court’s website, this trial handled 40 PHPU cases with the main agenda of hearing answers from the General Election Commission (KPU) as the respondent, statements from related parties, statements from the Election Supervisory Body (Bawaslu), as well as ratifying evidence from the parties involved. This trial is a continuation of a series of legal processes that began last April, and will continue until May 2024.

During the trial process, the Constitutional Court divided the handling of 40 PHPU legislative elections cases into two panels of judges. Panel I will hear 21 cases from electoral districts in three provinces, namely North Sumatra, Southeast Sulawesi and South Papua, while panel III will hear 19 cases from electoral districts in four provinces, namely South Sumatra, DKI Jakarta, North Kalimantan and Jambi.

The selection of this panel of judges is carried out carefully to ensure that each case receives treatment that is appropriate to its geographical and political context.

However, behind the serious atmosphere of the trial, drops of humor sometimes slipped into the tense legal process. One of them was when the Constitutional Court Judge, Arief Hidayat, made a joke regarding the extraordinary thickness of the Golkar Party’s case files. “This file could be a sleeping pillow,” he said jokingly. However, the joke also highlights the complexity and complexity of the legal process that the judges are currently facing.

However, in that moment, every word and action has its own weight. The presence of a cellphone ringing during the trial, for example, immediately resulted in a warning from Judge Arief Hidayat.

Even though it seems trivial, this warning reminds us of the importance of maintaining concentration and silence in the courtroom, as a form of respect for the ongoing legal process.

The trial also became the stage for fierce legal arguments between the parties involved. One of them is when the KPU refutes the applicant’s argument, as happened in the trial regarding the vote difference in the South Nias Electoral District 5.

Through testing data and facts, the KPU tried to prove that the allegation of vote difference was not legally proven. Processes like this show how important transparency and accuracy are at every stage of elections, as well as the need for strong mechanisms to resolve disputes that may arise.

Apart from that, the spotlight was also placed on the recapitulation information system (Sirekap) used by the KPU during the 2024 presidential election. Judge Arief Hidayat highlighted the problems that arose during the election, and reminded the KPU to improve the system ahead of the 2024 simultaneous Regional Head Elections (Pilkada). This reflects the importance of the reliability and integrity of information systems in maintaining public confidence in the election process.

However, amidst all the tension and scrutiny, it is important to remember that the main goal of this trial is to achieve justice and truth. Every case heard by the Constitutional Court must be decided based on strong evidence and careful legal consideration.

The decisions made by the Constitutional Court will have a broad impact on the entire community, and therefore, the process must be carried out with high integrity and caution.

In a broader context, maintaining harmony during the legislative election dispute hearing process is a must. The public and stakeholders are reminded to remain calm and respect the ongoing legal process.

Conflict and tension will not benefit anyone, and can actually disrupt the stability of our democracy. We all have a responsibility to maintain peace and uphold democratic values, even in situations filled with tension and differences of opinion.

The ongoing legislative election dispute trial at the Constitutional Court is one of the important moments in Indonesia’s democratic journey. In the process, upholding justice and legal integrity must be the main priority.
