The public needs to respect the ongoing legislative election process

Elections are a democratic celebration that is held periodically in Indonesia, where the people have the opportunity to elect their representatives in various legislative and executive institutions. However, in every election, it is not uncommon for disputes to arise related to voting results which trigger legal disputes.
The dispute was then brought to the Constitutional Court (MK) to be decided. Currently, a dispute trial is underway for the 2024 Legislative Election (Pileg) at the Constitutional Court which is in the spotlight of many parties, including the public and related institutions.
One of the main focuses in the 2024 legislative election dispute hearing at the Constitutional Court is the presence of the General Election Commission (KPU). The presence of the KPU in the trial process was considered crucial because it involved a voting dispute submitted by the applicant.
Member of Commission II DPR, Guspardi Gaus, emphasized the importance of respecting the Constitutional Court as a form of commitment to democracy and the electoral process. The Constitutional Justice issued a serious reprimand to the KPU for its absence from the dispute hearing, which was considered as an evaluation material for the performance of this election organizing institution.
Not only a warning, but also strong criticism was directed at the KPU for its lack of seriousness in responding to disputes over election results. This can be seen from the absence of members of the Indonesian KPU and provincial KPU at the trial at the Constitutional Court.
The importance of the KPU’s presence in the 2024 legislative election dispute hearing is not only related to legal obligations, but also to democratic principles that must be upheld. Director of the Indonesian Democracy and Electoral Empowerment Partnership (DEEP), Neni Nur Hayati, highlighted the importance of answering various substantive issues disputed in the trial. In this case, the data and lawsuit materials that determine the fate of the legislative candidate or party filing the lawsuit require proper clarification from the KPU.
Constitutional Justice Arief Hidayat highlighted this problem, emphasizing that the handling of election result disputes must be taken seriously by the KPU. The KPU’s absence from the session raises questions about the seriousness of this institution in handling issues that arise related to the election results.
In responding to the criticism and attention that emerged, KPU Commissioner Idham Holik stated that his party was very serious in preparing for the 2024 legislative election dispute trial. Even though the busy agenda was the reason for the absence of several commissioners at the trial, the KPU remained committed to attending and providing clarification on the substance of the disputed issues. .
The statement from the KPU regarding their readiness and commitment to face the 2024 legislative election dispute is a positive step. However, this commitment must be realized through concrete actions, including ensuring attendance at every stage of the trial and providing adequate explanations for the disputes raised.
The KPU was also reminded to take lessons from the warning given by the Constitutional Court, as a form of evaluation and improvement in the future. The presence and active participation of the KPU in the legal process is a reflection of their commitment to maintaining the integrity and legitimacy of the democratic process in Indonesia.
As an election organizing institution, the KPU has a big responsibility in maintaining the integrity and transparency of the democratic process. The presence of the KPU in legislative election dispute hearings at the Constitutional Court is part of the process of law enforcement and justice which must be upheld. However, if the KPU is not serious in responding to disputes over election results, this could damage public confidence in the democratic process as a whole.
Apart from that, it is important for the KPU to maintain transparency and accountability in every step it takes. The election process must be carried out openly and fairly, so that people have confidence that their voting rights are respected and counted correctly.
When there is a dispute over election results, the KPU must be ready to provide convincing evidence and explanations, so that the legal process can run smoothly and fairly.
However, in assessing the ongoing legislative election dispute trial process, we also need to look at it from the community’s perspective. Awareness of the importance of respecting the legal process, including legislative election dispute hearings at the Constitutional Court, needs to be increased. The public must understand that the legal process is an integral part of the democratic system that must be upheld.
The public also has an important role in maintaining the integrity of the election process. They must be active in supervising and overseeing every stage of the election, from nomination to vote counting. By becoming active agents of change, the public can help ensure that the election process runs smoothly and fairly.
In the context of disputes over election results, such as the 2024 legislative election dispute trial at the Constitutional Court, it is important for all parties to respect and support the ongoing legal process. The KPU as an election organizing institution must be ready to provide the necessary clarifications and maintain transparency and accountability at every step.
Meanwhile, the public also needs to increase awareness of the importance of the legal process in maintaining the integrity of democracy.
Thus, the ongoing legislative election dispute trial process at the Constitutional Court can be a momentum for all of us to reflect again on the importance of respecting the legal process in a democratic system. Only by respecting the legal process can we build a strong foundation for a healthy and sustainable democracy in Indonesia.
