Omnibus Law is an effort to replace, revoke and / or change several legal norms and values into one law. At least the Omnibus Law has three patterns, namely reviewing laws, regulating new material and revoking related regulations, and setting economic policies. Next, the aim of the Omnibus Law is to minimize legal problems due to regulatory conflicts that often overlap. This Omnibus Law will make it easier for investors to enter Indonesia. Of course the people will think about their fate and future if it is true that several laws and regulations of the Omnibus Law are passed. The Omnibus Law can actually be used as an effort to overcome overlapping regulations. But that is not absolutely true. It is true that major issues in this country cannot be separated from the inherent rule of law.
In the Omnibus Law, there are around 1,244 articles in 79 laws covering 11 clusters covering simplification of licensing; investment requirements; manpower, facilities, empowerment and protection of micro, small and medium enterprises; ease of doing business; research and innovation support; government administration; imposition of sanctions; the land acquisition; government investment and projects; economic area, be it industrial area. The Omnibus Law, whose draft was compiled by the government, needs to analyze what matters substantially it wants to be fixed, so that the Omnibus Law does not become a new problem in the regulatory sector. The Omnibus Law must cover all substance issues that are the focus of the government because these laws and regulations will eliminate other regulations. Thus, the Omnibus Law must be discussed carefully, in detail and comprehensively by stakeholders.
However, there is a certain opinion that the Omnibus Law can add to the burden of regulation if it fails to be implemented. With its nature that includes more than one aspect combined into one law, it is feared that the discussion of the Omnibus Law will not be comprehensive. Discussions will focus on the Omnibus law and forget about the laws that will be repealed, which will present a more complex regulatory burden. Various circles are free to express their views because Indonesia is a democracy that respects all opinions of its people. This is also stated in Pancasila so that the pros and cons of the Omnibus Law are normal. However, the level of pros and cons needs to be controlled so that they are not wild and used by certain parties to undermine the credibility of the government. It is necessary to remember one thing that the government is always pro to society and willing to strive to advance the welfare of its people. The Omnibus Law is one of the government’s good efforts aimed at advancing the country’s economy by bringing in investors, but not forgetting the fate of local workers.
