Realization of Job Creation Perpu in Creating Jobs and Improving the Investment Climate in Indonesia

Jakarta – The government and the DPR agreed to bring the discussion results to Government Regulation in Lieu of Law (Perpu) Number 2 of 2022 concerning Job Creation to be ratified into law.

Wamenaker Afriansyah Noor answered various issues regarding the Work Creation Perpu in a discussion held by the Moya Institute, Friday (3/3/2023). Including the issue of layoffs, which many consider to be carried out unilaterally.

“Regarding layoffs, which seem to be rumored to be carried out unilaterally, whereas in fact, in the Work Creation Perppu, layoffs must be carried out by two parties and have prior approval and absolutely cannot be done unilaterally. If there is a dispute, an industrial settlement will be carried out,” he said.

This is important to discuss because it involves investment in the country of Indonesia. UGM Professor of Business Law, Prof. Nindyo Pramono said that the issuance of this Perpu Ciptaker was a structural reform of job creation regulations.

“The data has also shown that with the existence of the Ciptaker Law, investors responded very positively to this, because it is an effort by the government to carry out structural reforms. It is clear that the existence of these structural reforms has a positive impact on increasing foreign investment in Indonesia,” he said.

Prof. Nindyo also said that with the Perpu Cipta Kerja, the investment climate in Indonesia could improve amid global uncertainty due to the Covid-19 pandemic.

“The realization of the investment value in 2022 has clearly increased, this has been since the enactment of the Job Creation Law,” he said.

In addition, the Job Creation Perpu was formed because there are juridical interests that cannot be separated from the pressing crisis caused by the global economic turmoil due to the Covid-19 pandemic which has resulted in layoffs.

“There is a compelling crisis in the aspect of employment in Indonesia which is part of why it is important to issue the Job Creation Perppu,” he said.

On the same occasion, Political Observer, Emrus Sihombing mentioned several benefits from the Perpu Ciptaker, one of which created a lot of jobs.

“In accordance with the name of this law, namely Job Creation, so as to create jobs. So in the future the Indonesian people will no longer apply for jobs abroad, instead there will be many people who set up businesses. This includes facilitating the licensing of individual PTs, MSMEs and so on,” he said.

“The benefit is that the number of unemployed in Indonesia will be increasingly depressed and could even be close to zero. Indonesia also has great potential to become a very advanced country in the economic field with the help of appropriate policies such as the Job Creation Law.” he concluded.
