SUPPORT THE GOVERNMENT IMPLEMENTING THE OMNIBUS LAW
After the inauguration speech of Joko Widodo (Jokowi) as President of the Republic of Indonesia for the 2019-2024 period on October 20, 2019, the term Omnibus Law has become increasingly popular. The formation of a number of Drafts – Omnibus Law – which has been included in the Priority Prolegnas has become the flagship program of the Jokowi-Ma’ruf Amin Government in order to boost economic growth. A number of groups have criticized the formation of the Omnibus Law for various reasons and arguments. Not a few groups support the formation of the Omnibus Law as one of the regulatory reform strategies to overcome obesity / hyper-regulatory conditions, especially in the ease of doing business sector. Civil society, labor organizations, and legal experts have shared their views on the omnibus law as a method of drafting a new regulation (UU) as well as replacing / deleting several articles in one or more applicable regulations.
The idea of forming the omnibus law is commonly applied in countries that adhere to the common law system. Thus, there is an opinion that if the Omnibus Law is implemented in Indonesia, it will actually cause new problems in the legislative drafting system. Furthermore, the Omnibus Law is considered to cause legal uncertainty and complicate various regulations in Indonesia. By including the Omnibus Law, some even argue that Indonesia gives all its resources without being given in kind reciprocity. It should be noted that the formation of the Omnibus Law is directed to be broader, more comprehensive, and integrated in the framework of structuring the legal system and statutory regulations based on Pancasila and the 1945 Constitution.
One of the advantages of Omnibus Law is the practicality of correcting many problematic regulations. Thus, the Omnibus Law can increase the speed in drafting laws, by compiling an omnibus law as well as correcting problematic laws that are in effect. The omnibus law approach can also be a solution to overlapping regulations in Indonesia both in horizontal and vertical parallel hierarchical relationships. However, some circles admit that the preparation of the Omnibus Law is expensive and not simple because it has multi-sector substance and is prepared for super power. With the noble purpose of the Omnibus Law, it is only natural that the Indonesian people support its implementation. The Indonesian economy is currently weakening due to Covid-19 which is endemic in Indonesia, so that business people and the public find it difficult to survive. If the government does not act immediately, it is believed that Indonesia’s economy will continue to deteriorate until eventually there is no way to improve it. So that this does not happen, let us support the government to implement the Omnibus Law. The government believes that the Omnibus Law can attract investors to invest in Indonesia so that in the future it can open up new jobs and improve the welfare of people in Indonesia.
