The Government Supports the General Election Commission (KPU) to Appeal the Decision on Postponement of Elections at the Central Jakarta District Court

Jakarta – The Government of Indonesia firmly supports the efforts being made by the Indonesian KPU in order to appeal the decision on the postponement of the 2024 Election which was carried out by the Central Jakarta District Court (PN) when it granted the lawsuit from the Adil Makmur People’s Party (Prima Party).

Recently, namely on Thursday 2 March 2023, the Central Jakarta District Court (PN) has granted the lawsuit filed by the Adil Makmur People’s Party (Partai Prima) to the General Elections Commission (KPU) as of 8 December 2022 then, to postpone the holding of the general elections (elections) in 2024.

For information, the lawsuit was filed, because the Prima Party felt they were disadvantaged because they were deemed not to have passed the results of the election administration. Meanwhile, on the other hand, the KPU will take legal action in the form of an appeal against the decision issued by the Central Jakarta District Court (PN Jakpus).

On another occasion, the Vice President of the Republic of Indonesia (Wapres RI), KH Ma’ruf Amin emphasized that the decision issued by the Central Jakarta District Court was not a final decision, because they are a judicial institution. So with that, the plan to hold elections in 2024 will still continue.

Emphatically, the Vice President of the Republic of Indonesia stated that all the preparations that have been made to hold the 2024 elections will certainly continue, while the decision from the Central Jakarta District Court itself still requires legitimacy and will still be processed again. Furthermore, he also stated that the government is currently still waiting for the results of the appeal filed by the KPU against the charge.

Then on the other hand, Ma’ruf Amin said that the government is also conducting a review of the results of the decision of the Central Jakarta District Court, whether they really have the authority to postpone the 2024 elections or not.

Efforts from the General Election Commission (KPU) to appeal the decision of the Central Jakarta District Court regarding the postponement of the 2024 elections have indeed been made. In fact, the President of the Republic of Indonesia (RI), Joko Widodo himself supports the KPU to continue to appeal the decision.

Jokowi then stated that the Government of Indonesia had a very strong commitment to continue to support the smooth running of the 2024 General Election (Election). Furthermore, he explained that the budget for the implementation of the 2024 Election in Indonesia itself had indeed been prepared by the government.

Then, the KPU itself has also ensured that they are not at all disturbed after the Central Jakarta District Court’s decision to postpone the election due to a lawsuit from the Prima Party. The KPU even emphasized that until now the stages of the election itself were still running in accordance with the applicable regulations.

The General Election Commission (KPU) ensures that it will appeal the decision of the Central Jakarta District Court (PN Jakpus) before the deadline on March 16, 2023. Regarding this matter, the KPU Commissioner, Mochammad Afifudin explained that an appeal can be filed at least 14 calendar days after the verdict. He also ensured that currently the KPU is preparing materials for an appeal memory.

On another occasion, the KPU Commissioner, Betty Epsilon Idroos also confirmed that her party would hold a plenary meeting to compile the contents of the appeal memory. He also hopes that in the near future the KPU can immediately submit an appeal to the High Court.

The Head of the RI KPU Technical Division, Idham Holik said that currently his party is completing the entire voter data updating process, which has been carried out since February 12 to March 14, 2023. Not only completing the process of updating voter data, but the KPU is also continuing verification.

This verification is related to factual data regarding voter support for prospective DPD members, which is known that the registration of the requirements for DPD candidates themselves will be held from 1 to 14 May 2023. Several other preparations were also made by the KPU RI, as clear evidence that it was not at all bothered by the Central Jakarta District Court’s decision.

Other preparations made by the KPU are currently carrying out the legal drafting process for the PKPU draft related to legislative nominations. This is because, according to Idham, based on the Election Law itself, the KPU must have received the proposal for prospective legislative members 9 months before voting day. The Central Jakarta District Court’s decision to postpone the 2024 elections to grant the claim from the Prima Party continues to generate controversy among the public. Related to this, the Government of the Republic of Indonesia even provided support to the Indonesian KPU to continue its appeal against the decision.
