Perppu Ciptaker Becomes a Solution So that there is no Abuse of Power
Jakarta – Polemic on the issuance of Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation ( Perppu Ciptaker ) has been sticking out lately. Constitutional law expert at UNS, Agus Riewanto , stated that the Constitutional Court’s decision only stated that the Ciptaker Law was conditionally unconstitutional, which meant that the way it was made needed to be corrected, but the content (material) was deemed necessary by the state.
Riewanto explained, if only Perppu Ciptaker is the same as the omnibus law does not exist at this time, the President’s performance can be considered abuse of power ( abuse of power ).
” The Perppu is to provide certainty that the government can work based on the law. If not there then abuse of power . So, from the perspective of constitutional law, it is better for the government to run even though the rules are wrong than there are no rules,” said Riewanto at the Moya national webinar . Previously reported, Perppu Ciptaker is considered to be another solution to the Ciptaker Law which the Constitutional Court declared in 2020 conditionally unconstitutional and must be corrected for the next two years.
It is known, President Jokowi at the end of last year passed the Perppu For its legitimacy, Ciptaker is facing a global recession and is currently being discussed in parliament.
Then, the Chancellor of ITB-Ahmad Dahlan Mukhaer Pakkanna revealed, Perppu Ciptaker , which was published recently, still has the same goal of expanding employment, reducing unemployment, and especially targeting entry investment .
It’s just that Mukhaer highlighted the meaning of urgency to force according to the 1945 Constitution whose definition is determined by the President so that it can be considered as subjectivity to ratify Perppu creator .
Meanwhile, Executive Director of SMRC Sirojudin Abbas said, based on a survey the level of public confidence in Jokowi’s ability to bring Indonesia out of the economic crisis was still relatively high, reaching 75 percent.
Therefore it also influences the level of satisfaction with the President’s performance in terms of supporting the issuance of the Perppu Ciptaker as a solution to overcoming the threat of a global recession has reached 60 percent.
The survey also yielded results, said Sirojudin, that 22 percent of the public knew about the issuance of the Perppu Ciptaker and the threat of a global recession, as many as 51 percent actually agree with the existence of this regulation.
Meanwhile Executive Director Moya In the webinar , Institute Hery Sucipto said that the problem of creators requires serious attention because it involves public needs and interests that affect the national economic sector.(*)
