The Job Creation Law Facilitates Investment in the Marine Sector

Opinion, suaradewata.com – The government and the DPR have officially enacted the Job Creation Law as an effort to cut regulations. This legal product is believed to be able to increase investment, including in the marine sector.

Minister of Marine Affairs and Fisheries, Sakti Wahyu Trenggono said that out of a total of 51 implementing regulations for the Job Creation Law, three of them were related to the marine and fisheries sectors. One of them is government regulation Number 27 of 2021 concerning the implementation of the Marine and Fisheries Sector which was stipulated on February 2, 2021.

Trenggono assessed that this regulation was the government’s effort to facilitate investment, particularly the Ministry of Marine Affairs and Fisheries (KKP) to unravel overlapping regulations that could hinder investment.

Through this regulation, the KKP has made extraordinary breakthroughs to support the policies launched by President Joko Widodo.
He considered, some of the advantages of this rule. First, in the use of marine space, the obligation is to protect marine and fishery resources, such as not destroying coral reefs, so that they can be maintained and sustainable.

Second, the realization of integrated and harmonious management of marine and fisheries. Third, in the capture fisheries sector, making breakthroughs in various fishing boat licenses, which have been scattered in various ministries, is sufficient only in KKP.

This policy is certainly very suitable for the president, namely the existence of structural reforms and accelerated economic transformation through trimming a number of regulations and procedures to make it easier for the community.

This regulation also regulates the provision of social security for fishing boat crews. In addition, it also includes provisions on the import of fishery and salt commodities.

Through this PP, there is a paradigm shift in law enforcement in the field of KKP. “Supervision and sanctions, which have been oriented towards punishment, are perfected in this PP by using and prioritizing administrative sanctions.

Meanwhile, Artati Widiarti, the Director General for Strengthening the Competitiveness of Marine and Fishery Products (PDSKP), reported that so far foreign investment, aka PMA, has been dominated by China. Followed by Singapore, Thailand, India and Japan.

The five provinces that are the main destinations for investment are East Java, DKI Jakarta, Lampung, Maluku and West Java.

Previously, the Ministry of Marine Affairs and Fisheries (KKP) stated that investment opportunities in the national marine and fisheries sector are getting wider because simplification of licensing has become one of the focuses of this ministry.

Acting Director General of Capture Fisheries M Zaini gave an example of one of the fisheries management areas that have not been optimally worked on, among others, the WPPNRI 711 (covering the waters of the Karimata Strait, Natuna Sea and South China Sea), namely in areas above 14 nautical miles, the exclusive economic zone to the high seas.

He is of the opinion that the existence of the Job Creation Law will not make it difficult for fishermen but instead will side with the fishermen.

Even before the Job Creation Law was issued, the KKP’s Directorate General of Capture Fisheries had initiated a fast online licensing, where 1 hour of permits could be issued through the fast service permit information system (SILAT). Thousands of permits have been issued since the service’s launch at the end of 2019.

According to Zaini, the existence of the Job Creation Law also makes the requirements for capture fisheries business permits easier. Several documents that were previously regulated and under the authority of the Ministry of Transportation have now become the authority of the KKP. Of the dozens of documents required have now been trimmed.

He also highlighted that the ease of doing business provided by the government is not misused, because the presence of online services and paperless permits has the potential to lead to acts of legal violations such as document falsification.

For this reason, his party will also take firm action if this is found in the field.

It should also be noted that business actors can access the www.oss.go.id page to register through the OSS system. However, if business actors experience difficulties in applying for a SIUP permit in the Fish Processing Sector, KKP opens a consultation room via telephone, email and call center.

In addition, KKP has also coordinated and at the same time opened a consultation service for the issuance of SIUP for Fish Management at the Investment Coordinating Board (BKPM).

This service can be accessed at the 64th floor counters of PTSP Building III, the Office of the Investment Coordinating Board (BKPM) since February 1, 2020.

The Job Creation Law is expected to be able to have a positive impact on business actors in managing permits according to their respective types of processing businesses. So that the investment ecosystem and ease of doing business will increase.
