The existence of the Job Creation Perppu aims to continue to improve the welfare of all Indonesian people. Starting from the expansion of job openings to reduce the number of unemployed to guarantees for workers who have been laid off, to encouragement and assistance to the MSME sector carried out by the Government of Indonesia.
Various international institutions have indeed predicted that world economic conditions in 2023 will be filled with high uncertainty. Given this, it is not impossible that these conditions will also affect the economy in Indonesia.
Therefore, as a step to be able to anticipate this uncertainty and at the same time to be able to guarantee the creation of legal certainty because the Job Creation Law was previously deemed conditionally unconstitutional through a Constitutional Court (MK) Decision, finally the Government of the Republic of Indonesia (RI) issued a Government Regulation in Lieu of Law -Law (Perppu) Number 2 of 2022 concerning Job Creation (Ciptaker).
In this regard, the Dean of the Postgraduate Postgraduate Program at Saburai University, Bandar Lampung, Idham Manaf, stated that the issuance of the Job Creation Perppu, which was signed directly by the President of the Republic of Indonesia, Joko Widodo on December 30, 2022, was an anticipatory step.
This is because the world’s economic conditions in 2023 are filled with uncertainty, which could also have an impact on hampering efforts to accelerate national economic recovery after being hit by the COVID-19 pandemic some time ago. If this policy is not issued immediately, then of course the country’s economic conditions will worsen.
Meanwhile, on the other hand, the Government of the Republic of Indonesia really does not want Indonesia to fall again and experience a big recession after a few years ago, so it is indeed very important to immediately issue a Perppu on Job Creation as a legal umbrella.
Furthermore, Idham Manaf also considered that the issuance of the Job Creation Perppu could be a very appropriate momentum to further assist the acceleration of economic recovery and growth in the country. Not without reason, because the policy is also an effort by the Government of Indonesia to create and expand employment opportunities.
Indeed, it has become one of the government’s programs, namely in order to be able to suppress and reduce the number of unemployed in Indonesia and to be able to continue to accommodate new workers. So that the Perppu Cipta Kerja is very helpful in creating these jobs.
This also includes the government continuing to encourage the development of Cooperatives and Micro, Small and Medium Enterprises (MSMEs) with the aim of improving the national economy which will be able to participate in improving people’s welfare.
In addition, the Dean of Postgraduate Studies at Saburai University also explained that the existence of the Job Creation Perppu which has been consulted with the People’s Representative Council of the Republic of Indonesia (DPR RI) is expected to be able to create a much more conducive investment climate due to the filling of the legal vacuum that was previously left by The old Copyright Law.
The stipulation of Perppu Number 2 of 2022 concerning Job Creation itself is also able to guarantee an increase in the welfare of workers or laborers in Indonesia. How could it not be, because for example, workers who have experienced termination of employment (PHK) will be given a job loss guarantee of 45 percent of their salary and also receive training in the form of retraining and reskilling.
Both of these, namely the Job Loss Guarantee and also all training provided for 6 (six) months to workers affected by layoffs. So they don’t have to worry anymore if the company lays off them because the Government of Indonesia has guaranteed and facilitated the welfare of the workers.
On the other hand, the Government of Indonesia itself remains optimistic that the existence of the Job Creation Perppu will indeed bring many benefits to society. In this regard, Member of the Regional People’s Representative Council (DPRD) of Bandar Lampung, Hermawan, explained that the purpose of issuing this regulation was to create broad jobs for the Indonesian people evenly throughout the territory of the Unitary State of the Republic of Indonesia (NKRI).
All efforts made by the government are none other than in the context of fulfilling the right to a decent living for the people as mandated by the Preamble to the 1945 Constitution of the Republic of Indonesia.
The welfare of all Indonesian people is indeed guaranteed by the Job Creation Perppu, because starting from being able to create broad job opportunities to various kinds of guarantees for workers when they are laid off, including efforts to continue to encourage and help the progress of the MSME sector in the country .
